黑龙江省方正县人民政府关于建立完善守信联合激励和失信联合惩戒制度加快推进信用方正建设的实施意见

  为贯彻(che)落实《国务院关于深(shen)入推(tui)进实施新一轮东北振兴战略加(jia)快推(tui)动(dong)东北地区经济企(qi)稳(wen)向好(hao)若干重要举措的意见(jian)》(国发〔2016〕62号)、《国务院关于建立完善守信联合激励和失信联合惩戒制度加快推进社会诚信建设的指导意见》(国发〔2016〕33号)、《黑龙江省人民政府关于建立完善守信联合激励和失信联合惩戒制度加快推进社会诚信建设的实施意见》(黑政规〔2017〕5号)和《哈尔滨市人民政府关于建立完善守信联合激励和失信联合惩戒制度推动信用东北建设实施意见》(哈政规〔2017〕24号)精神,积极构建以信用为核心的行政管理、市场监管和社会治理体系,加快推进“信用方正”建设,现结合我县实际,提出如下意见。

  一(yi)、总(zong)体要求

(一)指导思想

  全面贯彻党(dang)的(de)十九大和习近平(ping)总书记系列重要讲话(hua)精(jing)神(shen),按照国家省和市的(de)决(jue)策部署,紧紧围绕“四个全面”战略布局和“五大”发展理念,落实加强和创新社会治理要求,加快推进全县社会信用体系建设。加强信用信息归集共享、公开应用,依法依规运用信用激励和约束手段,构建政府、社会共同参与的跨地区、跨部门、跨领域的守信联合激励和失信联合惩戒机制,促进市场主体依法诚信经营,维护市场正常秩序,营造良好信用环境。

(二)基本原则

1.坚持信(xin)(xin)(xin)(xin)用公(gong)开(kai)。在做好信(xin)(xin)(xin)(xin)用信(xin)(xin)(xin)(xin)息记录归集工作的(de)基础上,逐步将社(she)会法人、自然人和社(she)会组织等各(ge)类(lei)社(she)会信(xin)(xin)(xin)(xin)用主体的(de)信(xin)(xin)(xin)(xin)用信(xin)(xin)(xin)(xin)息统一归集并(bing)公(gong)开(kai)。

2.坚持奖惩分明(ming)。充分运(yun)用信(xin)用激励和约(yue)束手(shou)段,建(jian)立健全(quan)守信(xin)者受(shou)益、失信(xin)者受(shou)限的奖惩机制(zhi)。

3.坚(jian)持突出重点。着力解(jie)决(jue)涉及公共利益和(he)安全、人民群众反映强烈(lie)、对(dui)社会发展负面影响较(jiao)大(da)的(de)重点领(ling)域失(shi)信问题。

4.坚持协同联(lian)动。构建政府部门协同联(lian)动、行业组织(zhi)自(zi)律管理、信(xin)用服务机构积极参与、社会舆论广泛监督的共(gong)同治理格局。

(三)工作目(mu)标

  进一步加(jia)大(da)(da)失信(xin)违约惩(cheng)戒力(li)度(du),突(tu)出抓好政(zheng)府违约专项整治,大(da)(da)力(li)倡导做诚(cheng)信(xin)之人、办诚(cheng)信(xin)之企、建诚(cheng)信(xin)政(zheng)府。到2018年4月底,基本建立经济社会主要领域守信联合激励和失信联合惩戒机制。到2020年,初步形成政府部门协同联动、行业组织自律管理、信用服务机构积极参与、社会舆论广泛参与的共同治理工作格局,基本建立跨地区、跨部门、跨领域的守信联合激励和失信联合惩戒工作机制,以信用为核心的新型市场监管机制作用得到有效发挥,全社会信用意识普遍增强,“信用方正”建设取得积极效果。

  二、重点工作任务

(一)建立完(wan)善守信联合激励(li)机制

1.多渠道选树(shu)诚信(xin)(xin)(xin)(xin)典(dian)型(xing)。2018年4月底前,各部门(men)和社(she)会组织(zhi)建(jian)(jian)立并完善(shan)社(she)会法(fa)人(ren)、自然人(ren)和社(she)会组织(zhi)信(xin)(xin)(xin)(xin)用评价(jia)机制,及时、全面、准确(que)记录信(xin)(xin)(xin)(xin)用主体(ti)的信(xin)(xin)(xin)(xin)用信(xin)(xin)(xin)(xin)息;建(jian)(jian)立常(chang)态化报送工作机制,依(yi)(yi)托市信(xin)(xin)(xin)(xin)用信(xin)(xin)(xin)(xin)息共享平台共享信(xin)(xin)(xin)(xin)息,联合相(xiang)关部门(men)和社(she)会组织(zhi)实施(shi)守(shou)(shou)信(xin)(xin)(xin)(xin)激励(li)。开展诚信(xin)(xin)(xin)(xin)创建(jian)(jian)活动,依(yi)(yi)法(fa)依(yi)(yi)规(gui)将信(xin)(xin)(xin)(xin)用状况良(liang)好的行(xing)政(zheng)相(xiang)对(dui)人(ren)、“诚信(xin)(xin)(xin)(xin)示范(fan)单位(wei)”、“守(shou)(shou)合同重信(xin)(xin)(xin)(xin)用”企业、“诚信(xin)(xin)(xin)(xin)经营示范(fan)点”、诚信(xin)(xin)(xin)(xin)道德模范(fan)、优(you)秀青年志愿者、行(xing)业协会商会推(tui)荐的诚信(xin)(xin)(xin)(xin)会员、新闻(wen)媒体(ti)挖掘的诚信(xin)(xin)(xin)(xin)主体(ti)等树(shu)立为诚实守(shou)(shou)信(xin)(xin)(xin)(xin)典(dian)型(xing)。(县市场监管局、县文明(ming)办、县民政(zheng)局分(fen)别牵头,各部门(men)按职责(ze)分(fen)工负责(ze))

2.完善行(xing)(xing)政审(shen)批(pi)(pi)绿(lv)色通(tong)(tong)道(dao)。2018年3月(yue)底前,各部(bu)门行(xing)(xing)政审(shen)批(pi)(pi)机构依据(ju)权力清单和责任清单,针对(dui)诚信(xin)典(dian)型和连续3年无(wu)不良信(xin)用记录的行(xing)(xing)政相对(dui)人,制定实施“绿(lv)色通(tong)(tong)道(dao)”、“容缺受理”等行(xing)(xing)政审(shen)批(pi)(pi)便利服(fu)务措施。对(dui)符合开辟绿(lv)色通(tong)(tong)道(dao)的行(xing)(xing)政相对(dui)人,通(tong)(tong)过召开协调会、提前介入等方式先行(xing)(xing)受理,加(jia)快办理速度。(县(xian)行(xing)(xing)政审(shen)批(pi)(pi)服(fu)务中心牵头(tou),各部(bu)门按(an)职(zhi)责分工负责)

3.优(you)(you)先提(ti)(ti)供便利(li)化公共服务。通过(guo)查询省、市信(xin)(xin)(xin)用(yong)(yong)信(xin)(xin)(xin)息共享(xiang)平台信(xin)(xin)(xin)用(yong)(yong)信(xin)(xin)(xin)息或使用(yong)(yong)第(di)三方信(xin)(xin)(xin)用(yong)(yong)服务机构提(ti)(ti)供的信(xin)(xin)(xin)用(yong)(yong)报(bao)告等方式(shi),在实施财政(zheng)性资金项目安排、招商引(yin)资配套优(you)(you)惠(hui)(hui)政(zheng)策等各(ge)类政(zheng)府优(you)(you)惠(hui)(hui)政(zheng)策中,优(you)(you)先考虑守信(xin)(xin)(xin)市场主(zhu)(zhu)体(ti)。对守信(xin)(xin)(xin)主(zhu)(zhu)体(ti)给予重点支持和优(you)(you)先便利(li)。(县(xian)(xian)发改局(ju)、县(xian)(xian)财政(zheng)局(ju)、县(xian)(xian)国税(shui)局(ju)、县(xian)(xian)地税(shui)局(ju)、县(xian)(xian)市场监管局(ju)分别牵头,各(ge)部门按职责分工负责)

4.创(chuang)新(xin)(xin)守(shou)(shou)(shou)信(xin)(xin)企(qi)业(ye)(ye)行政监管(guan)。县(xian)市场(chang)(chang)监管(guan)部(bu)(bu)门(men)(men)在企(qi)业(ye)(ye)监管(guan)、食(shi)(shi)品药品安(an)全(quan)、消费(fei)安(an)全(quan)、安(an)全(quan)生产等领域(yu),根据监管(guan)对象(xiang)的(de)信(xin)(xin)用记(ji)录(lu)和信(xin)(xin)用评价分(fen)类(lei),运用信(xin)(xin)息化手段(duan),创(chuang)新(xin)(xin)市场(chang)(chang)经营交易行为监管(guan)方(fang)式,为市场(chang)(chang)主体提供便利服务。依(yi)据国家和省、市明确(que)的(de)守(shou)(shou)(shou)信(xin)(xin)激励手段(duan),制(zhi)定本部(bu)(bu)门(men)(men)事中、事后监管(guan)实施(shi)方(fang)案,对符合一定条件的(de)守(shou)(shou)(shou)信(xin)(xin)企(qi)业(ye)(ye),优化日常检查(cha)和专(zhuan)项检查(cha)频次。(县(xian)市场(chang)(chang)监管(guan)局、县(xian)安(an)监局、县(xian)商务粮食(shi)(shi)局分(fen)别(bie)牵头(tou),各部(bu)(bu)门(men)(men)按职责(ze)分(fen)工负责(ze))

5.提(ti)供(gong)市场(chang)优惠(hui)服(fu)务(wu)。鼓励有关部(bu)门(men)和金融机构、商业销(xiao)售机构等(deng)市场(chang)服(fu)务(wu)机构大力开发“信(xin)(xin)易(yi)贷”、“信(xin)(xin)易(yi)债(zhai)”、“税易(yi)贷”等(deng)守(shou)信(xin)(xin)激(ji)励产品(pin),规范(fan)提(ti)供(gong)市场(chang)主(zhu)体(ti)信(xin)(xin)用(yong)信(xin)(xin)息、信(xin)(xin)用(yong)积分(fen)(fen)和信(xin)(xin)用(yong)评价(jia)结果,对守(shou)信(xin)(xin)市场(chang)主(zhu)体(ti)给予优惠(hui)和便利,使守(shou)信(xin)(xin)者获得(de)更多机会和实(shi)惠(hui)。(县人(ren)民银行(xing)、县银监局(ju)、县国税局(ju)、县地税局(ju)分(fen)(fen)别牵(qian)头,各部(bu)门(men)按职责分(fen)(fen)工负责)

6.多渠道推(tui)(tui)介守(shou)(shou)信(xin)(xin)(xin)(xin)(xin)市(shi)(shi)(shi)场(chang)主(zhu)体(ti)。各(ge)部(bu)门(men)应(ying)及(ji)时将守(shou)(shou)信(xin)(xin)(xin)(xin)(xin)市(shi)(shi)(shi)场(chang)主(zhu)体(ti)优良信(xin)(xin)(xin)(xin)(xin)用(yong)信(xin)(xin)(xin)(xin)(xin)息(xi)报送至县(xian)(xian)信(xin)(xin)(xin)(xin)(xin)用(yong)办(ban),由县(xian)(xian)信(xin)(xin)(xin)(xin)(xin)用(yong)办(ban)向上级主(zhu)管部(bu)门(men)报送在(zai)“信(xin)(xin)(xin)(xin)(xin)用(yong)哈尔滨”网(wang)站进(jin)行(xing)公示,并(bing)在(zai)会(hui)(hui)展、银(yin)企(qi)对(dui)(dui)接等活动(dong)(dong)中(zhong)重(zhong)点推(tui)(tui)介守(shou)(shou)信(xin)(xin)(xin)(xin)(xin)企(qi)业,让诚信(xin)(xin)(xin)(xin)(xin)成为(wei)市(shi)(shi)(shi)场(chang)配置资源(yuan)的重(zhong)要考量因(yin)素。大力宣(xuan)(xuan)传守(shou)(shou)信(xin)(xin)(xin)(xin)(xin)企(qi)业、群体(ti)和个人,积极评选诚实守(shou)(shou)信(xin)(xin)(xin)(xin)(xin)道德模范。支(zhi)持征信(xin)(xin)(xin)(xin)(xin)机构加(jia)强对(dui)(dui)市(shi)(shi)(shi)场(chang)主(zhu)体(ti)正面信(xin)(xin)(xin)(xin)(xin)息(xi)的采集,在(zai)失信(xin)(xin)(xin)(xin)(xin)问题反映(ying)较为(wei)集中(zhong)的行(xing)业领域,加(jia)大对(dui)(dui)守(shou)(shou)信(xin)(xin)(xin)(xin)(xin)者的激励(li)性评分比(bi)重(zhong)。推(tui)(tui)动(dong)(dong)行(xing)业协会(hui)(hui)商(shang)会(hui)(hui)加(jia)强信(xin)(xin)(xin)(xin)(xin)用(yong)建设和行(xing)业自(zi)(zi)律(lv),表彰守(shou)(shou)信(xin)(xin)(xin)(xin)(xin)会(hui)(hui)员。引(yin)导企(qi)业主(zhu)动(dong)(dong)发布综(zong)合信(xin)(xin)(xin)(xin)(xin)用(yong)承诺(nuo)或产品服务质(zhi)量等专项(xiang)承诺(nuo),开展产品服务标准等自(zi)(zi)我(wo)声明公开,主(zhu)动(dong)(dong)接受(shou)社会(hui)(hui)监督。(县(xian)(xian)委(wei)宣(xuan)(xuan)传部(bu)、县(xian)(xian)文(wen)明办(ban)、县(xian)(xian)住建局(ju)、县(xian)(xian)国土资源(yuan)局(ju)、县(xian)(xian)市(shi)(shi)(shi)场(chang)监管局(ju)、县(xian)(xian)旅(lv)游局(ju)、县(xian)(xian)民政局(ju)分别牵(qian)头,各(ge)部(bu)门(men)按职责分工负责)

(二)健(jian)全完善失信联合(he)惩(cheng)戒(jie)机(ji)制

7.对(dui)重(zhong)(zhong)点领域(yu)严(yan)(yan)重(zhong)(zhong)失信(xin)行(xing)(xing)(xing)(xing)(xing)为(wei)(wei)(wei)实(shi)(shi)(shi)施(shi)联(lian)合惩戒。2018年3月底前,各部门和(he)(he)社会(hui)组织要制定(ding)本领域(yu)失信(xin)行(xing)(xing)(xing)(xing)(xing)为(wei)(wei)(wei)认定(ding)、等(deng)(deng)级划分(fen)和(he)(he)分(fen)类监管(guan)实(shi)(shi)(shi)施(shi)措施(shi),对(dui)失信(xin)行(xing)(xing)(xing)(xing)(xing)为(wei)(wei)(wei)进行(xing)(xing)(xing)(xing)(xing)处理和(he)(he)评价(jia),并通过(guo)市信(xin)用(yong)(yong)信(xin)息(xi)(xi)共享平台实(shi)(shi)(shi)现信(xin)息(xi)(xi)共享,推动其他部门和(he)(he)社会(hui)组织依(yi)法(fa)(fa)依(yi)规对(dui)重(zhong)(zhong)点领域(yu)严(yan)(yan)重(zhong)(zhong)失信(xin)行(xing)(xing)(xing)(xing)(xing)为(wei)(wei)(wei)采取(qu)联(lian)合惩戒措施(shi)。一(yi)是(shi)严(yan)(yan)重(zhong)(zhong)危害(hai)人民(min)(min)群众(zhong)身体健康和(he)(he)生命安(an)全的(de)(de)行(xing)(xing)(xing)(xing)(xing)为(wei)(wei)(wei),包(bao)(bao)括食品(pin)药品(pin)、生态(tai)环(huan)境、工程质量、安(an)全生产、消(xiao)防安(an)全、强(qiang)制性产品(pin)认证(zheng)等(deng)(deng)领域(yu)的(de)(de)严(yan)(yan)重(zhong)(zhong)失信(xin)行(xing)(xing)(xing)(xing)(xing)为(wei)(wei)(wei)。二是(shi)严(yan)(yan)重(zhong)(zhong)破(po)坏(huai)市场秩(zhi)序(xu)和(he)(he)社会(hui)正(zheng)常秩(zhi)序(xu)的(de)(de)行(xing)(xing)(xing)(xing)(xing)为(wei)(wei)(wei),包(bao)(bao)括贿赂、逃(tao)(tao)税骗(pian)税、套取(qu)骗(pian)取(qu)住房公(gong)积金(jin)、故(gu)意(yi)拖欠(qian)(qian)或(huo)(huo)少缴以及违规使(shi)用(yong)(yong)各类资(zi)金(jin)(基(ji)金(jin))、恶(e)意(yi)逃(tao)(tao)废债务(wu)、恶(e)意(yi)拖欠(qian)(qian)货(huo)款或(huo)(huo)服务(wu)费(fei)、恶(e)意(yi)欠(qian)(qian)薪、非法(fa)(fa)集资(zi)、不(bu)正(zheng)当(dang)竞争、合同欺诈、传销、无(wu)证(zheng)照经营、制售假(jia)(jia)(jia)冒(mao)伪劣产品(pin)和(he)(he)故(gu)意(yi)侵犯知识产权(quan)、出借和(he)(he)借用(yong)(yong)资(zi)质投标(biao)、虚假(jia)(jia)(jia)投标(biao)、围标(biao)串标(biao)、虚假(jia)(jia)(jia)广告、侵害(hai)消(xiao)费(fei)者(zhe)或(huo)(huo)证(zheng)券期货(huo)投资(zi)者(zhe)合法(fa)(fa)权(quan)益(yi)、严(yan)(yan)重(zhong)(zhong)破(po)坏(huai)网(wang)络空(kong)间传播秩(zhi)序(xu)、聚众(zhong)扰乱(luan)社会(hui)秩(zhi)序(xu)等(deng)(deng)严(yan)(yan)重(zhong)(zhong)失信(xin)行(xing)(xing)(xing)(xing)(xing)为(wei)(wei)(wei)。三是(shi)拒不(bu)履行(xing)(xing)(xing)(xing)(xing)法(fa)(fa)定(ding)义(yi)务(wu),严(yan)(yan)重(zhong)(zhong)影响司法(fa)(fa)机(ji)关(guan)、行(xing)(xing)(xing)(xing)(xing)政机(ji)关(guan)公(gong)信(xin)力的(de)(de)行(xing)(xing)(xing)(xing)(xing)为(wei)(wei)(wei),包(bao)(bao)括当(dang)事人在司法(fa)(fa)机(ji)关(guan)、行(xing)(xing)(xing)(xing)(xing)政机(ji)关(guan)作出判决(jue)或(huo)(huo)决(jue)定(ding)后,有履行(xing)(xing)(xing)(xing)(xing)能力但拒不(bu)履行(xing)(xing)(xing)(xing)(xing)、逃(tao)(tao)避执行(xing)(xing)(xing)(xing)(xing)等(deng)(deng)严(yan)(yan)重(zhong)(zhong)失信(xin)行(xing)(xing)(xing)(xing)(xing)为(wei)(wei)(wei)。四是(shi)拒不(bu)履行(xing)(xing)(xing)(xing)(xing)国防义(yi)务(wu),拒绝、逃(tao)(tao)避兵役,拒绝、拖延民(min)(min)用(yong)(yong)资(zi)源(yuan)征(zheng)用(yong)(yong)或(huo)(huo)者(zhe)阻(zu)碍对(dui)被征(zheng)用(yong)(yong)的(de)(de)民(min)(min)用(yong)(yong)资(zi)源(yuan)进行(xing)(xing)(xing)(xing)(xing)改造(zao),危害(hai)国防利益(yi),破(po)坏(huai)国防设施(shi)等(deng)(deng)行(xing)(xing)(xing)(xing)(xing)为(wei)(wei)(wei)。(各部门按职责(ze)分(fen)工负责(ze))

8.对(dui)(dui)失(shi)信(xin)行(xing)为(wei)(wei)实(shi)施(shi)行(xing)政(zheng)(zheng)性(xing)约束(shu)和(he)(he)惩戒。各部(bu)(bu)(bu)门将(jiang)严重(zhong)失(shi)信(xin)主体列为(wei)(wei)重(zhong)点监(jian)(jian)管(guan)对(dui)(dui)象,并根据监(jian)(jian)管(guan)职(zhi)权和(he)(he)国家、省(sheng)、市(shi)有关部(bu)(bu)(bu)署,于2018年(nian)3月底前制定、发(fa)(fa)布针对(dui)(dui)严重(zhong)失(shi)信(xin)主体的(de)行(xing)政(zheng)(zheng)性(xing)约束(shu)和(he)(he)惩戒具体措施(shi),明确实(shi)施(shi)主体、工作流程等(deng),依法(fa)依规实(shi)施(shi)惩戒。从严审(shen)核行(xing)政(zheng)(zheng)许(xu)可审(shen)批项(xiang)目(mu)(mu),从严控制生(sheng)产许(xu)可证发(fa)(fa)放(fang),限(xian)制新(xin)增项(xiang)目(mu)(mu)审(shen)批、核准,限(xian)制发(fa)(fa)起设立或参股金(jin)(jin)融(rong)机构以(yi)及小(xiao)额(e)贷款公司、融(rong)资(zi)(zi)担保公司、创业(ye)投资(zi)(zi)企业(ye)、互(hu)联网融(rong)资(zi)(zi)平台等(deng)机构,限(xian)制从事(shi)(shi)互(hu)联网信(xin)息(xi)服务(wu)等(deng)。严格限(xian)制申请财政(zheng)(zheng)性(xing)资(zi)(zi)金(jin)(jin)项(xiang)目(mu)(mu),限(xian)制参与(yu)有关公共资(zi)(zi)源(yuan)交易活(huo)动,限(xian)制参与(yu)基础设施(shi)和(he)(he)公用事(shi)(shi)业(ye)特许(xu)经营。对(dui)(dui)严重(zhong)失(shi)信(xin)企业(ye)及其(qi)法(fa)定代表人(ren)、主要负(fu)(fu)(fu)责(ze)人(ren)和(he)(he)对(dui)(dui)失(shi)信(xin)行(xing)为(wei)(wei)负(fu)(fu)(fu)有直接责(ze)任的(de)注册执(zhi)业(ye)人(ren)员等(deng),实(shi)施(shi)市(shi)场和(he)(he)行(xing)业(ye)禁入措施(shi)。及时撤(che)销严重(zhong)失(shi)信(xin)企业(ye)及其(qi)法(fa)定代表人(ren)、负(fu)(fu)(fu)责(ze)人(ren)、高级管(guan)理人(ren)员和(he)(he)对(dui)(dui)失(shi)信(xin)行(xing)为(wei)(wei)负(fu)(fu)(fu)有直接责(ze)任的(de)董事(shi)(shi)、股东等(deng)人(ren)员的(de)荣誉(yu)称号,并取消其(qi)参加评(ping)先评(ping)优资(zi)(zi)格。(县(xian)(xian)发(fa)(fa)改局(ju)(ju)、县(xian)(xian)财政(zheng)(zheng)局(ju)(ju)、县(xian)(xian)工信(xin)局(ju)(ju)、县(xian)(xian)市(shi)场监(jian)(jian)管(guan)局(ju)(ju)、县(xian)(xian)住建局(ju)(ju)、县(xian)(xian)商务(wu)粮食局(ju)(ju)、县(xian)(xian)交通运输局(ju)(ju)分别(bie)牵头,各部(bu)(bu)(bu)门按职(zhi)责(ze)分工负(fu)(fu)(fu)责(ze))

11.对失(shi)(shi)信行(xing)为实施社会(hui)性约束和惩戒。充分(fen)发(fa)挥公(gong)(gong)(gong)益(yi)慈善类社会(hui)组织、民办非(fei)企业(ye)单位等各类社会(hui)组织作用,引导社会(hui)力(li)量广(guang)泛参与失(shi)(shi)信联合(he)惩戒。支持有(you)关社会(hui)组织依法对污染环(huan)境、侵(qin)害消费者(zhe)或公(gong)(gong)(gong)众投资者(zhe)合(he)法权益(yi)等群(qun)体性侵(qin)权行(xing)为提起公(gong)(gong)(gong)益(yi)诉讼。鼓(gu)励(li)公(gong)(gong)(gong)正、独立、有(you)条(tiao)件(jian)的社会(hui)机构开(kai)展(zhan)失(shi)(shi)信行(xing)为大数据舆情(qing)监测,编制发(fa)布本行(xing)业(ye)信用分(fen)析报告。(县(xian)公(gong)(gong)(gong)安(an)局(ju)、县(xian)民政局(ju)、县(xian)环(huan)保局(ju)、县(xian)市(shi)场监管局(ju)分(fen)别(bie)牵头,各部门按职责分(fen)工负责)。

12.实(shi)施个(ge)(ge)人(ren)(ren)(ren)(ren)失(shi)信(xin)行(xing)为(wei)联(lian)合(he)惩(cheng)戒(jie)(jie)。各部门要逐步建立健全个(ge)(ge)人(ren)(ren)(ren)(ren)信(xin)用(yong)(yong)档案,加(jia)强个(ge)(ge)人(ren)(ren)(ren)(ren)信(xin)用(yong)(yong)信(xin)息记(ji)录和归(gui)集,逐步推动失(shi)信(xin)联(lian)合(he)惩(cheng)戒(jie)(jie)措施落(luo)实(shi)到(dao)人(ren)(ren)(ren)(ren)。对企事(shi)(shi)(shi)业(ye)单(dan)位(wei)(wei)严重(zhong)失(shi)信(xin)行(xing)为(wei),在(zai)记(ji)入企事(shi)(shi)(shi)业(ye)单(dan)位(wei)(wei)信(xin)用(yong)(yong)记(ji)录的(de)(de)(de)同时,记(ji)入其法定代表人(ren)(ren)(ren)(ren)、主要负(fu)责(ze)(ze)人(ren)(ren)(ren)(ren)和其他负(fu)有直接责(ze)(ze)任(ren)人(ren)(ren)(ren)(ren)员的(de)(de)(de)个(ge)(ge)人(ren)(ren)(ren)(ren)信(xin)用(yong)(yong)档案。在(zai)对失(shi)信(xin)企事(shi)(shi)(shi)业(ye)单(dan)位(wei)(wei)进(jin)行(xing)联(lian)合(he)惩(cheng)戒(jie)(jie)的(de)(de)(de)同时,依法依规对相(xiang)关责(ze)(ze)任(ren)人(ren)(ren)(ren)(ren)员采取相(xiang)应的(de)(de)(de)联(lian)合(he)惩(cheng)戒(jie)(jie)措施。(各部门按职(zhi)责(ze)(ze)分工负(fu)责(ze)(ze))

16.建(jian)立健全(quan)信(xin)用修复(fu)机制(zhi)。各(ge)(ge)领域联合惩戒(jie)(jie)措施发起单(dan)(dan)位(wei)和(he)实施单(dan)(dan)位(wei)应按照法律法规、政策规定明确(que)各(ge)(ge)类失信(xin)行(xing)(xing)为的(de)(de)联合惩戒(jie)(jie)期(qi)限(xian)。对在(zai)规定期(qi)限(xian)内纠正失信(xin)行(xing)(xing)为、消除不(bu)良影响(xiang)的(de)(de),不(bu)再(zai)作为联合惩戒(jie)(jie)对象。2018年4月底前,各(ge)(ge)有关(guan)部(bu)门要明确(que)本部(bu)门、本行(xing)(xing)业信(xin)用修复(fu)条(tiao)件和(he)程序,建(jian)立有利于自我(wo)纠错、主动自新的(de)(de)社(she)会(hui)鼓励与关(guan)爱机制(zhi)。利用教育培训、强化指导等手(shou)段(duan),支持有失信(xin)行(xing)(xing)为的(de)(de)个人(ren)通过社(she)会(hui)公益服务(wu)等方式修复(fu)个人(ren)信(xin)用,重(zhong)塑诚实守信(xin)形象。(各(ge)(ge)部(bu)门按职责分(fen)工负责)

17.建立健全信(xin)(xin)(xin)用(yong)(yong)主体(ti)权(quan)益保护(hu)机制(zhi)。各(ge)部门(men)在执行(xing)失信(xin)(xin)(xin)联合(he)(he)(he)惩戒措施时主动(dong)发现、经信(xin)(xin)(xin)用(yong)(yong)主体(ti)提出异议申请或(huo)投(tou)诉发现信(xin)(xin)(xin)息不实的,应(ying)及时告知信(xin)(xin)(xin)息提供单(dan)位核实,信(xin)(xin)(xin)息提供单(dan)位应(ying)尽快核实并反馈。联合(he)(he)(he)惩戒措施在信(xin)(xin)(xin)息核实期间暂不执行(xing)。经核实有误(wu)的信(xin)(xin)(xin)息应(ying)及时更正或(huo)撤销。对因(yin)错误(wu)采取联合(he)(he)(he)惩戒措施损害有关主体(ti)合(he)(he)(he)法(fa)权(quan)益的,有关部门(men)和单(dan)位应(ying)积(ji)极采取措施恢复其信(xin)(xin)(xin)誉,消除不良影(ying)响。支持有关主体(ti)通过行(xing)政(zheng)(zheng)复议、行(xing)政(zheng)(zheng)诉讼等方式维(wei)护(hu)自身合(he)(he)(he)法(fa)权(quan)益。(各(ge)部门(men)按(an)职责分工(gong)负(fu)责)

(一(yi))强(qiang)化组织实施。各部门要按(an)照本《意见》要求(qiu),切(qie)实加强(qiang)组织领导(dao),明确(que)责(ze)任分工(gong),细化目标任务,确(que)保将联合(he)奖惩各项工(gong)作落实到位。

(二)完(wan)善配套(tao)制度(du)。各部(bu)(bu)门要(yao)加快制定本部(bu)(bu)门、本行业“红黑名单”发(fa)布、守信联(lian)(lian)合激(ji)励和(he)(he)失信联(lian)(lian)合惩戒(jie)等制度(du)措施,积极(ji)发(fa)起和(he)(he)配合其他单位做(zuo)好守信联(lian)(lian)合激(ji)励和(he)(he)失信联(lian)(lian)合惩戒(jie)工作。

(三)加强指导协调。县信(xin)用办要加大指导力度,积极(ji)帮助各(ge)部门(men)(men)协调建立(li)联合奖惩(cheng)机制,各(ge)部门(men)(men)要主动作为,扎(zha)实推动本部门(men)(men)、本行(xing)业守信(xin)联合激励和失信(xin)联合惩(cheng)戒工作。

(四)健全报(bao)送机制(zhi)(zhi)。各部(bu)门(men)要(yao)按照《关于建(jian)立我市报(bao)送守信(xin)(xin)激励和失(shi)信(xin)(xin)惩戒典型案例(li)工(gong)作(zuo)机制(zhi)(zhi)的通知》(哈(ha)诚(cheng)办发〔2017〕1号)要(yao)求,建(jian)立常态(tai)化报(bao)送机制(zhi)(zhi),负责组织、筛选和认定本(ben)部(bu)门(men)、本(ben)行业守信(xin)(xin)失(shi)信(xin)(xin)典型案例(li),实(shi)时或(huo)至少每(mei)月20日(ri)前向县(xian)信(xin)(xin)用办报(bao)送,依(yi)法依(yi)规(gui)公开。

(五(wu))加大考核力度。将本《意见》明确的工作任务(wu)纳(na)入(ru)年(nian)度县(xian)直机(ji)关专(zhuan)项(xiang)工作责任目标、乡(xiang)镇(zhen)经济社会发展主要责任指(zhi)标考核范围。县(xian)信用办要加强(qiang)对各(ge)乡(xiang)镇(zhen)、各(ge)部门的督促(cu)检(jian)查,及时跟踪掌握各(ge)项(xiang)工作进展情况,督促(cu)检(jian)查任务(wu)落实(shi)情况并及时报县(xian)政(zheng)府。
