黑龙江省方正县人民政府关于建立完善守信联合激励和失信联合惩戒制度加快推进信用方正建设的实施意见

  各乡(镇)人民政府,县政府各直属单位,各有关单位:

  为贯彻落实《国务院关于深入推进实施新一轮东北振(zhen)兴战略加快推动东北地区(qu)经(jing)济企(qi)稳(wen)向好(hao)若干重要举措的意见》(国发〔2016〕62号)、《国务院关于建立完善守信联合激励和失信联合惩戒制度加快推进社会诚信建设的指导意见》(国发〔2016〕33号)、《黑龙江省人民政府关于建立完善守信联合激励和失信联合惩戒制度加快推进社会诚信建设的实施意见》(黑政规〔2017〕5号)和《哈尔滨市人民政府关于建立完善守信联合激励和失信联合惩戒制度推动信用东北建设实施意见》(哈政规〔2017〕24号)精神,积极构建以信用为核心的行政管理、市场监管和社会治理体系,加快推进“信用方正”建设,现结合我县实际,提出如下意见。

  一、总体要求

(一)指导思(si)想

  全面贯(guan)彻党的十九大和(he)习(xi)近(jin)平总书记系(xi)列重要讲话(hua)精神,按照国(guo)家(jia)省和(he)市的决策部署(shu),紧(jin)紧(jin)围绕(rao)“四个全面”战略布局和“五大”发展理念,落实加强和创新社会治理要求,加快推进全县社会信用体系建设。加强信用信息归集共享、公开应用,依法依规运用信用激励和约束手段,构建政府、社会共同参与的跨地区、跨部门、跨领域的守信联合激励和失信联合惩戒机制,促进市场主体依法诚信经营,维护市场正常秩序,营造良好信用环境。

(二)基本原则

1.坚(jian)持信(xin)(xin)用公开。在做好(hao)信(xin)(xin)用信(xin)(xin)息(xi)记录(lu)归集工作的基础上,逐步将(jiang)社会法人(ren)、自然人(ren)和社会组(zu)织等(deng)各类(lei)社会信(xin)(xin)用主体的信(xin)(xin)用信(xin)(xin)息(xi)统一归集并公开。

2.坚持奖惩分(fen)明(ming)。充分(fen)运用(yong)信用(yong)激励和约束手段,建立健全守(shou)信者(zhe)受(shou)益、失信者(zhe)受(shou)限的奖惩机制。

3.坚持(chi)突出重点。着力解决涉及公(gong)共利益和安全、人民(min)群(qun)众(zhong)反映(ying)强烈、对社会发展(zhan)负面影响(xiang)较大的重点领域失信问题。

4.坚持协(xie)同联动(dong)。构建政(zheng)府(fu)部门(men)协(xie)同联动(dong)、行业组(zu)织自律管理(li)、信用服务机构积极参与(yu)、社会舆(yu)论广泛监督的(de)共同治理(li)格局。

(三(san))工作(zuo)目标

  进(jin)一步加大(da)失信违约惩戒(jie)力度,突出(chu)抓好政(zheng)府违约专(zhuan)项整治,大(da)力倡导做诚(cheng)信之人、办诚(cheng)信之企、建诚(cheng)信政(zheng)府。到(dao)2018年4月底,基本建立经济社会主要领域守信联合激励和失信联合惩戒机制。到2020年,初步形成政府部门协同联动、行业组织自律管理、信用服务机构积极参与、社会舆论广泛参与的共同治理工作格局,基本建立跨地区、跨部门、跨领域的守信联合激励和失信联合惩戒工作机制,以信用为核心的新型市场监管机制作用得到有效发挥,全社会信用意识普遍增强,“信用方正”建设取得积极效果。

  二、重点工(gong)作(zuo)任务(wu)

(一)建立完善守信(xin)联合激励机制

1.多(duo)渠道选树诚(cheng)信(xin)(xin)(xin)(xin)(xin)典(dian)(dian)型。2018年4月底前,各部门(men)和(he)社(she)会(hui)组(zu)织建(jian)立并(bing)完(wan)善社(she)会(hui)法(fa)人、自然人和(he)社(she)会(hui)组(zu)织信(xin)(xin)(xin)(xin)(xin)用(yong)评价机制(zhi),及时(shi)、全面、准(zhun)确(que)记录信(xin)(xin)(xin)(xin)(xin)用(yong)主(zhu)体的信(xin)(xin)(xin)(xin)(xin)用(yong)信(xin)(xin)(xin)(xin)(xin)息(xi);建(jian)立常(chang)态化报送工作(zuo)机制(zhi),依托市信(xin)(xin)(xin)(xin)(xin)用(yong)信(xin)(xin)(xin)(xin)(xin)息(xi)共享(xiang)(xiang)平台共享(xiang)(xiang)信(xin)(xin)(xin)(xin)(xin)息(xi),联合相关部门(men)和(he)社(she)会(hui)组(zu)织实(shi)施守(shou)信(xin)(xin)(xin)(xin)(xin)激励(li)。开展诚(cheng)信(xin)(xin)(xin)(xin)(xin)创(chuang)建(jian)活动,依法(fa)依规将信(xin)(xin)(xin)(xin)(xin)用(yong)状况良好的行政相对人、“诚(cheng)信(xin)(xin)(xin)(xin)(xin)示范单位”、“守(shou)合同重(zhong)信(xin)(xin)(xin)(xin)(xin)用(yong)”企业(ye)、“诚(cheng)信(xin)(xin)(xin)(xin)(xin)经营(ying)示范点”、诚(cheng)信(xin)(xin)(xin)(xin)(xin)道德模范、优秀青年志愿者、行业(ye)协会(hui)商会(hui)推荐的诚(cheng)信(xin)(xin)(xin)(xin)(xin)会(hui)员、新闻(wen)媒体挖掘的诚(cheng)信(xin)(xin)(xin)(xin)(xin)主(zhu)体等(deng)树立为诚(cheng)实(shi)守(shou)信(xin)(xin)(xin)(xin)(xin)典(dian)(dian)型。(县市场(chang)监管(guan)局、县文明办(ban)、县民政局分别牵头(tou),各部门(men)按职责分工负(fu)责)

2.完善行政(zheng)审批绿(lv)色通(tong)道。2018年3月底前,各部门行政(zheng)审批机构依据权力清(qing)单(dan)和责(ze)任清(qing)单(dan),针对(dui)诚信典型和连(lian)续3年无不良信用(yong)记录的行政(zheng)相(xiang)(xiang)对(dui)人,制定实施“绿(lv)色通(tong)道”、“容缺受理”等行政(zheng)审批便利(li)服务(wu)措施。对(dui)符合开辟绿(lv)色通(tong)道的行政(zheng)相(xiang)(xiang)对(dui)人,通(tong)过召(zhao)开协调会、提前介入等方式先行受理,加快办(ban)理速(su)度(du)。(县行政(zheng)审批服务(wu)中(zhong)心牵头(tou),各部门按职责(ze)分工负责(ze))

3.优(you)先(xian)提(ti)供便(bian)利化(hua)公共(gong)服(fu)务。通过查(cha)询(xun)省、市(shi)(shi)信(xin)(xin)用(yong)(yong)(yong)信(xin)(xin)息(xi)共(gong)享平台信(xin)(xin)用(yong)(yong)(yong)信(xin)(xin)息(xi)或使用(yong)(yong)(yong)第(di)三方信(xin)(xin)用(yong)(yong)(yong)服(fu)务机构(gou)提(ti)供的(de)信(xin)(xin)用(yong)(yong)(yong)报告等方式,在实施财政(zheng)(zheng)性资金项目安排、招(zhao)商引资配套优(you)惠政(zheng)(zheng)策(ce)等各(ge)(ge)类政(zheng)(zheng)府优(you)惠政(zheng)(zheng)策(ce)中,优(you)先(xian)考(kao)虑守信(xin)(xin)市(shi)(shi)场主体(ti)。对守信(xin)(xin)主体(ti)给(ji)予重(zhong)点支持和(he)优(you)先(xian)便(bian)利。(县(xian)(xian)(xian)(xian)发改局(ju)、县(xian)(xian)(xian)(xian)财政(zheng)(zheng)局(ju)、县(xian)(xian)(xian)(xian)国(guo)税(shui)局(ju)、县(xian)(xian)(xian)(xian)地税(shui)局(ju)、县(xian)(xian)(xian)(xian)市(shi)(shi)场监管局(ju)分别牵头,各(ge)(ge)部门按职(zhi)责分工负责)

4.创(chuang)新(xin)守(shou)信(xin)(xin)企业行(xing)政监(jian)(jian)管(guan)(guan)(guan)(guan)。县市场监(jian)(jian)管(guan)(guan)(guan)(guan)部(bu)(bu)门(men)在企业监(jian)(jian)管(guan)(guan)(guan)(guan)、食品药(yao)品安全、消费安全、安全生产(chan)等领域,根据监(jian)(jian)管(guan)(guan)(guan)(guan)对(dui)象的信(xin)(xin)用(yong)记录(lu)和(he)信(xin)(xin)用(yong)评价(jia)分类,运用(yong)信(xin)(xin)息(xi)化(hua)手段,创(chuang)新(xin)市场经营交易行(xing)为(wei)监(jian)(jian)管(guan)(guan)(guan)(guan)方式(shi),为(wei)市场主(zhu)体(ti)提供(gong)便利服务。依据国家和(he)省、市明确(que)的守(shou)信(xin)(xin)激励(li)手段,制定本(ben)部(bu)(bu)门(men)事中、事后(hou)监(jian)(jian)管(guan)(guan)(guan)(guan)实施方案,对(dui)符合一定条件的守(shou)信(xin)(xin)企业,优化(hua)日(ri)常检查和(he)专(zhuan)项(xiang)检查频次。(县市场监(jian)(jian)管(guan)(guan)(guan)(guan)局(ju)(ju)、县安监(jian)(jian)局(ju)(ju)、县商务粮食局(ju)(ju)分别牵头,各部(bu)(bu)门(men)按职责分工负责)

5.提(ti)(ti)供市(shi)场优惠(hui)服务。鼓励有(you)关(guan)部门(men)和金融(rong)机构(gou)(gou)、商业销售机构(gou)(gou)等市(shi)场服务机构(gou)(gou)大力开发“信(xin)易(yi)贷(dai)”、“信(xin)易(yi)债”、“税(shui)易(yi)贷(dai)”等守信(xin)激(ji)励产(chan)品,规范提(ti)(ti)供市(shi)场主体信(xin)用(yong)信(xin)息、信(xin)用(yong)积分和信(xin)用(yong)评价结果(guo),对守信(xin)市(shi)场主体给予(yu)优惠(hui)和便利,使守信(xin)者获(huo)得更多(duo)机会和实惠(hui)。(县人(ren)民银行、县银监局、县国税(shui)局、县地税(shui)局分别牵(qian)头,各部门(men)按职责(ze)(ze)分工负(fu)责(ze)(ze))

6.多渠道推(tui)介(jie)守(shou)(shou)(shou)信(xin)(xin)(xin)(xin)(xin)市(shi)场(chang)主体(ti)。各(ge)(ge)部门应及时将守(shou)(shou)(shou)信(xin)(xin)(xin)(xin)(xin)市(shi)场(chang)主体(ti)优良信(xin)(xin)(xin)(xin)(xin)用(yong)信(xin)(xin)(xin)(xin)(xin)息报送至县(xian)(xian)信(xin)(xin)(xin)(xin)(xin)用(yong)办,由县(xian)(xian)信(xin)(xin)(xin)(xin)(xin)用(yong)办向(xiang)上级主管(guan)部门报送在“信(xin)(xin)(xin)(xin)(xin)用(yong)哈(ha)尔滨(bin)”网站进行公(gong)示,并在会(hui)(hui)(hui)展、银企对接等活动(dong)(dong)中(zhong)重(zhong)点推(tui)介(jie)守(shou)(shou)(shou)信(xin)(xin)(xin)(xin)(xin)企业(ye),让(rang)诚(cheng)信(xin)(xin)(xin)(xin)(xin)成为(wei)市(shi)场(chang)配置资源(yuan)的(de)重(zhong)要考量(liang)因素。大力宣(xuan)传守(shou)(shou)(shou)信(xin)(xin)(xin)(xin)(xin)企业(ye)、群体(ti)和个(ge)人,积极(ji)评(ping)选诚(cheng)实守(shou)(shou)(shou)信(xin)(xin)(xin)(xin)(xin)道德(de)模范。支(zhi)持(chi)征信(xin)(xin)(xin)(xin)(xin)机构(gou)加(jia)强对市(shi)场(chang)主体(ti)正面信(xin)(xin)(xin)(xin)(xin)息的(de)采集,在失(shi)信(xin)(xin)(xin)(xin)(xin)问题反映较(jiao)为(wei)集中(zhong)的(de)行业(ye)领域,加(jia)大对守(shou)(shou)(shou)信(xin)(xin)(xin)(xin)(xin)者的(de)激励性评(ping)分(fen)比重(zhong)。推(tui)动(dong)(dong)行业(ye)协会(hui)(hui)(hui)商会(hui)(hui)(hui)加(jia)强信(xin)(xin)(xin)(xin)(xin)用(yong)建(jian)设和行业(ye)自律,表彰守(shou)(shou)(shou)信(xin)(xin)(xin)(xin)(xin)会(hui)(hui)(hui)员。引导(dao)企业(ye)主动(dong)(dong)发布综(zong)合信(xin)(xin)(xin)(xin)(xin)用(yong)承诺(nuo)或产品服务质(zhi)量(liang)等专项承诺(nuo),开展产品服务标准(zhun)等自我(wo)声明公(gong)开,主动(dong)(dong)接受社(she)会(hui)(hui)(hui)监督(du)。(县(xian)(xian)委宣(xuan)传部、县(xian)(xian)文明办、县(xian)(xian)住(zhu)建(jian)局(ju)(ju)、县(xian)(xian)国土(tu)资源(yuan)局(ju)(ju)、县(xian)(xian)市(shi)场(chang)监管(guan)局(ju)(ju)、县(xian)(xian)旅(lv)游局(ju)(ju)、县(xian)(xian)民政(zheng)局(ju)(ju)分(fen)别牵头,各(ge)(ge)部门按职责分(fen)工负责)

(二(er))健全完善失信联合(he)惩(cheng)戒机制

7.对重(zhong)(zhong)(zhong)点领(ling)(ling)(ling)域(yu)严(yan)(yan)重(zhong)(zhong)(zhong)失信(xin)(xin)(xin)行(xing)(xing)(xing)为(wei)(wei)(wei)实施(shi)联合(he)惩(cheng)戒。2018年3月(yue)底前,各(ge)部门(men)(men)和(he)(he)(he)社(she)会(hui)组(zu)织要制(zhi)定(ding)(ding)本领(ling)(ling)(ling)域(yu)失信(xin)(xin)(xin)行(xing)(xing)(xing)为(wei)(wei)(wei)认定(ding)(ding)、等(deng)(deng)级划分(fen)和(he)(he)(he)分(fen)类(lei)监管(guan)实施(shi)措施(shi),对失信(xin)(xin)(xin)行(xing)(xing)(xing)为(wei)(wei)(wei)进(jin)行(xing)(xing)(xing)处理和(he)(he)(he)评价,并(bing)通过市信(xin)(xin)(xin)用(yong)(yong)(yong)(yong)信(xin)(xin)(xin)息(xi)共(gong)享平台实现信(xin)(xin)(xin)息(xi)共(gong)享,推动其他部门(men)(men)和(he)(he)(he)社(she)会(hui)组(zu)织依法依规(gui)对重(zhong)(zhong)(zhong)点领(ling)(ling)(ling)域(yu)严(yan)(yan)重(zhong)(zhong)(zhong)失信(xin)(xin)(xin)行(xing)(xing)(xing)为(wei)(wei)(wei)采(cai)取联合(he)惩(cheng)戒措施(shi)。一(yi)是(shi)(shi)严(yan)(yan)重(zhong)(zhong)(zhong)危害(hai)人民(min)群众身体健康和(he)(he)(he)生命安全的(de)(de)行(xing)(xing)(xing)为(wei)(wei)(wei),包(bao)括食品药(yao)品、生态环(huan)境、工程质量、安全生产(chan)、消(xiao)防(fang)安全、强制(zhi)性产(chan)品认证等(deng)(deng)领(ling)(ling)(ling)域(yu)的(de)(de)严(yan)(yan)重(zhong)(zhong)(zhong)失信(xin)(xin)(xin)行(xing)(xing)(xing)为(wei)(wei)(wei)。二是(shi)(shi)严(yan)(yan)重(zhong)(zhong)(zhong)破坏市场秩(zhi)序和(he)(he)(he)社(she)会(hui)正常秩(zhi)序的(de)(de)行(xing)(xing)(xing)为(wei)(wei)(wei),包(bao)括贿赂、逃(tao)税骗(pian)税、套取骗(pian)取住房公积金(jin)、故(gu)意(yi)拖欠(qian)(qian)或(huo)(huo)(huo)少缴(jiao)以及违(wei)规(gui)使用(yong)(yong)(yong)(yong)各(ge)类(lei)资金(jin)(基(ji)金(jin))、恶意(yi)逃(tao)废债务(wu)、恶意(yi)拖欠(qian)(qian)货(huo)款或(huo)(huo)(huo)服务(wu)费、恶意(yi)欠(qian)(qian)薪、非法集资、不正当(dang)竞争、合(he)同欺诈、传销、无证照经营、制(zhi)售假(jia)冒伪劣产(chan)品和(he)(he)(he)故(gu)意(yi)侵犯知识(shi)产(chan)权、出借和(he)(he)(he)借用(yong)(yong)(yong)(yong)资质投标(biao)(biao)(biao)、虚假(jia)投标(biao)(biao)(biao)、围标(biao)(biao)(biao)串标(biao)(biao)(biao)、虚假(jia)广告、侵害(hai)消(xiao)费者(zhe)或(huo)(huo)(huo)证券(quan)期货(huo)投资者(zhe)合(he)法权益(yi)、严(yan)(yan)重(zhong)(zhong)(zhong)破坏网络空间(jian)传播秩(zhi)序、聚众扰(rao)乱社(she)会(hui)秩(zhi)序等(deng)(deng)严(yan)(yan)重(zhong)(zhong)(zhong)失信(xin)(xin)(xin)行(xing)(xing)(xing)为(wei)(wei)(wei)。三(san)是(shi)(shi)拒(ju)不履行(xing)(xing)(xing)法定(ding)(ding)义(yi)务(wu),严(yan)(yan)重(zhong)(zhong)(zhong)影响司法机关、行(xing)(xing)(xing)政机关公信(xin)(xin)(xin)力的(de)(de)行(xing)(xing)(xing)为(wei)(wei)(wei),包(bao)括当(dang)事(shi)人在司法机关、行(xing)(xing)(xing)政机关作(zuo)出判决或(huo)(huo)(huo)决定(ding)(ding)后(hou),有履行(xing)(xing)(xing)能力但拒(ju)不履行(xing)(xing)(xing)、逃(tao)避执行(xing)(xing)(xing)等(deng)(deng)严(yan)(yan)重(zhong)(zhong)(zhong)失信(xin)(xin)(xin)行(xing)(xing)(xing)为(wei)(wei)(wei)。四是(shi)(shi)拒(ju)不履行(xing)(xing)(xing)国防(fang)义(yi)务(wu),拒(ju)绝(jue)、逃(tao)避兵役,拒(ju)绝(jue)、拖延民(min)用(yong)(yong)(yong)(yong)资源征用(yong)(yong)(yong)(yong)或(huo)(huo)(huo)者(zhe)阻碍对被征用(yong)(yong)(yong)(yong)的(de)(de)民(min)用(yong)(yong)(yong)(yong)资源进(jin)行(xing)(xing)(xing)改造,危害(hai)国防(fang)利益(yi),破坏国防(fang)设施(shi)等(deng)(deng)行(xing)(xing)(xing)为(wei)(wei)(wei)。(各(ge)部门(men)(men)按职责分(fen)工负责)

8.对(dui)(dui)失信(xin)行(xing)为(wei)实施(shi)行(xing)政性(xing)约束和(he)惩(cheng)(cheng)戒。各(ge)部(bu)门(men)将严(yan)重(zhong)失信(xin)主体(ti)列为(wei)重(zhong)点监管(guan)对(dui)(dui)象(xiang),并根据监管(guan)职(zhi)权和(he)国家、省、市(shi)有(you)关(guan)部(bu)署,于2018年3月底前(qian)制(zhi)定、发(fa)布(bu)针对(dui)(dui)严(yan)重(zhong)失信(xin)主体(ti)的行(xing)政性(xing)约束和(he)惩(cheng)(cheng)戒具体(ti)措(cuo)施(shi),明确实施(shi)主体(ti)、工(gong)作流(liu)程(cheng)等,依法(fa)依规实施(shi)惩(cheng)(cheng)戒。从严(yan)审(shen)核(he)行(xing)政许(xu)可(ke)审(shen)批项(xiang)目,从严(yan)控制(zhi)生(sheng)产许(xu)可(ke)证发(fa)放,限制(zhi)新(xin)增(zeng)项(xiang)目审(shen)批、核(he)准,限制(zhi)发(fa)起设(she)立或参(can)股金融机(ji)构以及小(xiao)额(e)贷款公司、融资担保公司、创业(ye)投资企业(ye)、互联(lian)网融资平台等机(ji)构,限制(zhi)从事互联(lian)网信(xin)息服(fu)务等。严(yan)格限制(zhi)申请(qing)财政性(xing)资金项(xiang)目,限制(zhi)参(can)与有(you)关(guan)公共资源(yuan)交(jiao)易活(huo)动,限制(zhi)参(can)与基础(chu)设(she)施(shi)和(he)公用事业(ye)特许(xu)经营(ying)。对(dui)(dui)严(yan)重(zhong)失信(xin)企业(ye)及其(qi)(qi)法(fa)定代表(biao)人、主要负(fu)责(ze)人和(he)对(dui)(dui)失信(xin)行(xing)为(wei)负(fu)有(you)直接责(ze)任(ren)的注册执业(ye)人员(yuan)等,实施(shi)市(shi)场和(he)行(xing)业(ye)禁(jin)入(ru)措(cuo)施(shi)。及时撤(che)销(xiao)严(yan)重(zhong)失信(xin)企业(ye)及其(qi)(qi)法(fa)定代表(biao)人、负(fu)责(ze)人、高级管(guan)理人员(yuan)和(he)对(dui)(dui)失信(xin)行(xing)为(wei)负(fu)有(you)直接责(ze)任(ren)的董事、股东等人员(yuan)的荣誉(yu)称号,并取消其(qi)(qi)参(can)加评先评优(you)资格。(县(xian)发(fa)改局、县(xian)财政局、县(xian)工(gong)信(xin)局、县(xian)市(shi)场监管(guan)局、县(xian)住建(jian)局、县(xian)商务粮(liang)食局、县(xian)交(jiao)通运输(shu)局分别牵头,各(ge)部(bu)门(men)按职(zhi)责(ze)分工(gong)负(fu)责(ze))

11.对失信(xin)行(xing)为实(shi)施社会(hui)(hui)性约束和惩戒。充(chong)分发(fa)挥公益慈善类(lei)(lei)社会(hui)(hui)组织(zhi)、民办(ban)非企业(ye)单位(wei)等各类(lei)(lei)社会(hui)(hui)组织(zhi)作用(yong),引(yin)导社会(hui)(hui)力量广泛参与(yu)失信(xin)联合惩戒。支持(chi)有(you)关(guan)社会(hui)(hui)组织(zhi)依法对污染环(huan)境、侵害(hai)消费者或公众投资者合法权益等群(qun)体性侵权行(xing)为提起公益诉讼。鼓励公正、独立、有(you)条(tiao)件的(de)社会(hui)(hui)机构开展失信(xin)行(xing)为大数据舆情监(jian)测,编制发(fa)布本行(xing)业(ye)信(xin)用(yong)分析(xi)报告(gao)。(县(xian)(xian)(xian)公安局、县(xian)(xian)(xian)民政局、县(xian)(xian)(xian)环(huan)保(bao)局、县(xian)(xian)(xian)市场监(jian)管(guan)局分别牵(qian)头,各部门按职责分工负(fu)责)。

12.实(shi)(shi)施(shi)个(ge)人(ren)(ren)失(shi)信行为联(lian)合(he)惩戒。各部门要逐步建立(li)健全个(ge)人(ren)(ren)信用(yong)档(dang)案,加强个(ge)人(ren)(ren)信用(yong)信息记(ji)录和归集(ji),逐步推动(dong)失(shi)信联(lian)合(he)惩戒措(cuo)(cuo)施(shi)落(luo)实(shi)(shi)到人(ren)(ren)。对(dui)企事业(ye)单(dan)位严重失(shi)信行为,在记(ji)入企事业(ye)单(dan)位信用(yong)记(ji)录的(de)(de)同时,记(ji)入其法(fa)定代表人(ren)(ren)、主(zhu)要负(fu)责(ze)(ze)人(ren)(ren)和其他负(fu)有直(zhi)接责(ze)(ze)任人(ren)(ren)员的(de)(de)个(ge)人(ren)(ren)信用(yong)档(dang)案。在对(dui)失(shi)信企事业(ye)单(dan)位进行联(lian)合(he)惩戒的(de)(de)同时,依法(fa)依规(gui)对(dui)相关责(ze)(ze)任人(ren)(ren)员采取相应的(de)(de)联(lian)合(he)惩戒措(cuo)(cuo)施(shi)。(各部门按(an)职责(ze)(ze)分工负(fu)责(ze)(ze))

(三)构建(jian)守(shou)信联合激励和失(shi)信联合惩戒协同机制

13.深入(ru)推进信(xin)(xin)用(yong)(yong)信(xin)(xin)息(xi)(xi)归(gui)集共(gong)(gong)享(xiang)(xiang)和(he)发(fa)(fa)布(bu)应用(yong)(yong)。加强各行(xing)(xing)业信(xin)(xin)用(yong)(yong)信(xin)(xin)息(xi)(xi)系(xi)统(tong)建没,归(gui)集整(zheng)合(he)(he)(he)县域(yu)范围内社会(hui)(hui)信(xin)(xin)用(yong)(yong)主体的信(xin)(xin)用(yong)(yong)信(xin)(xin)息(xi)(xi),实现(xian)信(xin)(xin)用(yong)(yong)信(xin)(xin)息(xi)(xi)的广泛归(gui)集共(gong)(gong)享(xiang)(xiang)。依托市信(xin)(xin)用(yong)(yong)信(xin)(xin)息(xi)(xi)共(gong)(gong)享(xiang)(xiang)平台,于(yu)2018年4月底前建立守信(xin)(xin)联合(he)(he)(he)激(ji)(ji)励和(he)失(shi)(shi)信(xin)(xin)联合(he)(he)(he)惩(cheng)戒(jie)系(xi)统(tong),基本实现(xian)发(fa)(fa)起响应、信(xin)(xin)息(xi)(xi)推送、执行(xing)(xing)反馈、信(xin)(xin)用(yong)(yong)修复(fu)、异议(yi)处理等动态协(xie)同功(gong)能(neng)。各部(bu)门要依据权责清(qing)单,制定(ding)并完善信(xin)(xin)息(xi)(xi)查(cha)询事项目录(lu),将市信(xin)(xin)用(yong)(yong)信(xin)(xin)息(xi)(xi)共(gong)(gong)享(xiang)(xiang)平台信(xin)(xin)用(yong)(yong)信(xin)(xin)息(xi)(xi)查(cha)询应用(yong)(yong)嵌(qian)入(ru)审(shen)批和(he)监管(guan)(guan)工作流程(cheng),实现(xian)“应查(cha)必查(cha)”、“奖惩(cheng)到(dao)位”。健全政(zheng)府与征信(xin)(xin)机构、金(jin)融机构、行(xing)(xing)业协(xie)会(hui)(hui)商会(hui)(hui)等组织的信(xin)(xin)息(xi)(xi)共(gong)(gong)享(xiang)(xiang)机制,促进政(zheng)务(wu)信(xin)(xin)用(yong)(yong)信(xin)(xin)息(xi)(xi)与社会(hui)(hui)信(xin)(xin)用(yong)(yong)信(xin)(xin)息(xi)(xi)互动融合(he)(he)(he),最大限度(du)发(fa)(fa)挥守信(xin)(xin)联合(he)(he)(he)激(ji)(ji)励和(he)失(shi)(shi)信(xin)(xin)联合(he)(he)(he)惩(cheng)戒(jie)作用(yong)(yong)。(县市场监管(guan)(guan)局、县行(xing)(xing)政(zheng)审(shen)批服务(wu)中心分别牵头,各部(bu)门按职责分工负责)

14.完(wan)善(shan)(shan)信(xin)(xin)(xin)用“红(hong)(hong)黑(hei)名单(dan)(dan)(dan)”制(zhi)(zhi)度(du)。建(jian)立(li)(li)并(bing)完(wan)善(shan)(shan)各领(ling)域诚(cheng)信(xin)(xin)(xin)典型(xing)“红(hong)(hong)名单(dan)(dan)(dan)”制(zhi)(zhi)度(du)和(he)严(yan)重(zhong)失信(xin)(xin)(xin)主体“黑(hei)名单(dan)(dan)(dan)”制(zhi)(zhi)度(du),依法(fa)依规规范“红(hong)(hong)黑(hei)名单(dan)(dan)(dan)”产(chan)(chan)生和(he)发(fa)(fa)布行(xing)为,建(jian)立(li)(li)健全(quan)退出(chu)机制(zhi)(zhi)。其中(zhong),产(chan)(chan)品(pin)质量、环(huan)境保护、税收等重(zhong)点领(ling)域2018年3月(yue)底前实(shi)施。在保证(zheng)独立(li)(li)、公正、客(ke)观前提下,鼓励(li)有关群众团体、金融(rong)机构、征信(xin)(xin)(xin)机构、评级(ji)机构、行(xing)业协会商会等制(zhi)(zhi)定合理的(de)信(xin)(xin)(xin)用评价办法(fa),将产(chan)(chan)生的(de)“红(hong)(hong)黑(hei)名单(dan)(dan)(dan)”信(xin)(xin)(xin)息依托市信(xin)(xin)(xin)用信(xin)(xin)(xin)息共享平台在“信(xin)(xin)(xin)用哈尔(er)滨”网站发(fa)(fa)布,供政府部(bu)门和(he)社会参考(kao)使用。(县(xian)市场监(jian)管局、县(xian)环(huan)保局、县(xian)国(guo)税局、县(xian)地税局分(fen)别牵(qian)头,各部(bu)门按职责分(fen)工负责)

15.建立(li)(li)激(ji)励(li)和(he)(he)惩(cheng)(cheng)(cheng)戒措(cuo)(cuo)施(shi)(shi)清(qing)单制(zhi)(zhi)度。各部(bu)门要全面梳理法规和(he)(he)政(zheng)策明确的(de)联(lian)合激(ji)励(li)和(he)(he)惩(cheng)(cheng)(cheng)戒事项,建立(li)(li)守信联(lian)合激(ji)励(li)和(he)(he)失信联(lian)合惩(cheng)(cheng)(cheng)戒的(de)强制(zhi)(zhi)性(xing)、推荐性(xing)两类措(cuo)(cuo)施(shi)(shi)清(qing)单。强制(zhi)(zhi)性(xing)措(cuo)(cuo)施(shi)(shi)是(shi)指依法必须联(lian)合执(zhi)行(xing)的(de)激(ji)励(li)和(he)(he)惩(cheng)(cheng)(cheng)戒措(cuo)(cuo)施(shi)(shi);推荐性(xing)措(cuo)(cuo)施(shi)(shi)是(shi)指符合褒扬守信、惩(cheng)(cheng)(cheng)戒失信政(zheng)策导向,可根据实(shi)际情况(kuang)实(shi)施(shi)(shi)的(de)措(cuo)(cuo)施(shi)(shi)。县社会信用体系建设牵头单位于2018年(nian)3月(yue)底(di)前(qian)汇总并完善两级激(ji)励(li)和(he)(he)惩(cheng)(cheng)(cheng)戒措(cuo)(cuo)施(shi)(shi)清(qing)单,实(shi)行(xing)动(dong)态更新,作为实(shi)施(shi)(shi)联(lian)动(dong)奖(jiang)惩(cheng)(cheng)(cheng)依据。(各部(bu)门按职责(ze)分工(gong)负责(ze))

16.建立健(jian)全(quan)信(xin)(xin)(xin)用修(xiu)(xiu)复机制。各(ge)(ge)领(ling)域联合惩戒措(cuo)施(shi)发起(qi)单位(wei)(wei)和实施(shi)单位(wei)(wei)应(ying)按照法律法规(gui)(gui)、政策规(gui)(gui)定(ding)明(ming)确(que)各(ge)(ge)类失(shi)信(xin)(xin)(xin)行(xing)为(wei)的联合惩戒期限(xian)(xian)。对在规(gui)(gui)定(ding)期限(xian)(xian)内纠正失(shi)信(xin)(xin)(xin)行(xing)为(wei)、消(xiao)除不良影响的,不再作为(wei)联合惩戒对象。2018年4月底前,各(ge)(ge)有关(guan)部(bu)门(men)要明(ming)确(que)本部(bu)门(men)、本行(xing)业信(xin)(xin)(xin)用修(xiu)(xiu)复条件和程序,建立有利(li)于自我纠错、主动自新的社会(hui)鼓励与(yu)关(guan)爱(ai)机制。利(li)用教育培(pei)训、强(qiang)化指导等手段,支持有失(shi)信(xin)(xin)(xin)行(xing)为(wei)的个人通过社会(hui)公益(yi)服务等方式修(xiu)(xiu)复个人信(xin)(xin)(xin)用,重塑诚实守信(xin)(xin)(xin)形象。(各(ge)(ge)部(bu)门(men)按职责(ze)分工负责(ze))

17.建(jian)立健全信(xin)(xin)用(yong)主体权益(yi)(yi)保护机制。各部门在(zai)执行(xing)失信(xin)(xin)联合惩(cheng)戒(jie)措(cuo)(cuo)施时主动发现、经信(xin)(xin)用(yong)主体提(ti)出异议申请(qing)或投诉发现信(xin)(xin)息(xi)不(bu)实(shi)(shi)的(de),应及(ji)时告知信(xin)(xin)息(xi)提(ti)供单位核(he)(he)实(shi)(shi),信(xin)(xin)息(xi)提(ti)供单位应尽快(kuai)核(he)(he)实(shi)(shi)并反馈。联合惩(cheng)戒(jie)措(cuo)(cuo)施在(zai)信(xin)(xin)息(xi)核(he)(he)实(shi)(shi)期间暂不(bu)执行(xing)。经核(he)(he)实(shi)(shi)有误的(de)信(xin)(xin)息(xi)应及(ji)时更正或撤(che)销。对因错误采取联合惩(cheng)戒(jie)措(cuo)(cuo)施损害(hai)有关主体合法权益(yi)(yi)的(de),有关部门和单位应积极采取措(cuo)(cuo)施恢复其信(xin)(xin)誉,消除不(bu)良影响。支持有关主体通(tong)过行(xing)政复议、行(xing)政诉讼等(deng)方(fang)式(shi)维护自身合法权益(yi)(yi)。(各部门按(an)职责(ze)分工负(fu)责(ze))

20.加(jia)(jia)强诚(cheng)(cheng)(cheng)信(xin)(xin)(xin)(xin)教(jiao)育和(he)(he)文(wen)(wen)化建(jian)设。践行社(she)(she)(she)会主义(yi)核心(xin)价值观,秉持(chi)现(xian)代市场(chang)经(jing)济的(de)(de)契约精神(shen),把宣(xuan)(xuan)传教(jiao)育与诚(cheng)(cheng)(cheng)信(xin)(xin)(xin)(xin)文(wen)(wen)化结合起来提升公民诚(cheng)(cheng)(cheng)信(xin)(xin)(xin)(xin)意识和(he)(he)社(she)(she)(she)会诚(cheng)(cheng)(cheng)信(xin)(xin)(xin)(xin)水平。开(kai)展“百城万店(dian)无假货”、“诚(cheng)(cheng)(cheng)信(xin)(xin)(xin)(xin)做产(chan)品(pin)”、3.l5消费者权(quan)益(yi)日和(he)(he)食品(pin)安全宣(xuan)(xuan)传周等主题活动,引导(dao)广大社(she)(she)(she)会信(xin)(xin)(xin)(xin)用主体(ti)(ti)树立“诚(cheng)(cheng)(cheng)信(xin)(xin)(xin)(xin)兴商(shang)”理念,多渠道宣(xuan)(xuan)传诚(cheng)(cheng)(cheng)信(xin)(xin)(xin)(xin)企(qi)业、群体(ti)(ti)和(he)(he)个人(ren)。加(jia)(jia)大对(dui)守(shou)信(xin)(xin)(xin)(xin)联(lian)合激励和(he)(he)失(shi)信(xin)(xin)(xin)(xin)联(lian)合惩戒的(de)(de)宣(xuan)(xuan)传报(bao)(bao)道和(he)(he)案例剖析力(li)度(du),利用报(bao)(bao)刊(kan)、广播、电视(shi)、网(wang)络等媒体(ti)(ti)依(yi)法曝光社(she)(she)(she)会影(ying)响恶劣、情节严重(zhong)的(de)(de)失(shi)信(xin)(xin)(xin)(xin)案件,开(kai)展群众评议(yi)活动。披露失(shi)信(xin)(xin)(xin)(xin)败德(de)行为(wei),形成对(dui)严重(zhong)失(shi)信(xin)(xin)(xin)(xin)行为(wei)的(de)(de)舆论压力(li)和(he)(he)道德(de)约束。开(kai)展对(dui)公职人(ren)员(yuan)、企(qi)业负责人(ren)、会计审计人(ren)员(yuan)、保险经(jing)纪(ji)人(ren)、导(dao)游和(he)(he)学生等重(zhong)点人(ren)群的(de)(de)职业道德(de)建(jian)设,利用单位、社(she)(she)(she)区、学校、家(jia)庭,加(jia)(jia)强对(dui)失(shi)信(xin)(xin)(xin)(xin)个人(ren)的(de)(de)教(jiao)育和(he)(he)帮助。(县(xian)委宣(xuan)(xuan)传部(bu)、县(xian)文(wen)(wen)明办(ban)、县(xian)电视(shi)台分别(bie)牵头(tou),各部(bu)门按职责分工负责)

  三、保障(zhang)措(cuo)施

(一(yi))强化组织实施。各部门要(yao)按照本《意见》要(yao)求(qiu),切实加强组织领导(dao),明确(que)责任分(fen)工,细化目(mu)标(biao)任务(wu),确(que)保将联(lian)合(he)奖惩各项(xiang)工作落实到位。

(二)完善配(pei)套制度。各部门要加快制定本部门、本行(xing)业“红黑名单”发布、守信(xin)联合激励和(he)(he)失(shi)(shi)信(xin)联合惩戒等(deng)制度措施,积极(ji)发起和(he)(he)配(pei)合其他单位(wei)做好(hao)守信(xin)联合激励和(he)(he)失(shi)(shi)信(xin)联合惩戒工(gong)作。

(三)加强指导协(xie)调(diao)。县信用办要(yao)加大指导力度,积极(ji)帮助各部(bu)门(men)协(xie)调(diao)建立联合奖惩(cheng)机制,各部(bu)门(men)要(yao)主(zhu)动作为,扎实推动本部(bu)门(men)、本行(xing)业(ye)守信联合激励(li)和(he)失信联合惩(cheng)戒工作。

(四)健(jian)全报(bao)送(song)机制。各部(bu)门要按照《关于建立我市报(bao)送(song)守信激励和(he)失(shi)信惩戒典型案(an)例工(gong)作机制的通知》(哈(ha)诚办(ban)发〔2017〕1号)要求(qiu),建立常态化报(bao)送(song)机制,负责组(zu)织、筛选和(he)认定本部(bu)门、本行业守信失(shi)信典型案(an)例,实时(shi)或至少(shao)每月(yue)20日(ri)前向县信用办(ban)报(bao)送(song),依法(fa)依规(gui)公开(kai)。

(五)加(jia)大考(kao)核(he)(he)力度(du)。将本(ben)《意见》明(ming)确的工(gong)作(zuo)任务纳(na)入年度(du)县直机关专(zhuan)项工(gong)作(zuo)责(ze)任目标、乡镇(zhen)经(jing)济社会发展主要责(ze)任指标考(kao)核(he)(he)范围。县信(xin)用办(ban)要加(jia)强对各乡镇(zhen)、各部门的督促检查(cha),及时跟踪掌握各项工(gong)作(zuo)进展情况,督促检查(cha)任务落实情况并(bing)及时报(bao)县政府。
