  伊春市建立(li)完善守信(xin)联(lian)合激励和失(shi)信(xin)联(lian)合惩戒制度加快(kuai)推进社(she)会诚信(xin)建设(she)实施方案

  为贯彻落实《国务院关于建立(li)完(wan)善守信联(lian)合激(ji)励和失信联(lian)合惩戒制(zhi)度加(jia)快推(tui)进(jin)社会诚信建设的指(zhi)导(dao)意见》(国发〔2016〕33号)和《黑龙江省人民政府关于建立完善守信联合激励和失信联合惩戒制度加快推进社会诚信建设的实施意见》(黑政规〔2017〕5号)精神,结合我市实际,制定本方案。

  一、总体要求(qiu)

  (一)指导思想。全(quan)面贯(guan)(guan)彻党的(de)十(shi)八大(da)和(he)十(shi)八届三(san)中(zhong)、四中(zhong)、五中(zhong)、六中(zhong)全(quan)会精(jing)神,深入贯(guan)(guan)彻习近平总书(shu)记(ji)系列重(zhong)要讲话特(te)别是对我省(sheng)两次重(zhong)要讲话精(jing)神,按照(zhao)党中(zhong)央(yang)、国务院决策部署,紧(jin)紧(jin)围绕“四个全面”战略布局,牢固树立创新、协调、绿色、开放、共享发展理念,落实加强和创新社会治理要求,加快推进社会信用体系建设,加强信用信息公开和共享,依法依规运用信用激励和约束手段,构建政府、社会共同参与的跨地区、跨部门、跨领域的守信联合激励和失信联合惩戒机制,促进市场主体依法诚信经营,维护市场正常秩序,营造诚信社会环境。

  (二)工(gong)作目(mu)标。到2017年底,基本建立政府部门联合奖惩机制,推动企业、自然人、社团组织、机关事业单位信用信息的查询、公开共享和管理应用服务;建立完善信用分类管理、信用信息归集共享、信用信息公示、信用协同监管,使守信激励和失信惩戒机制在重要领域较好发挥作用。到2020年底,全面建成政府与社会共同参与的联合奖惩机制,形成政府部门协同联动、行业组织自律管理、信用服务机构积极参与、社会舆论广泛监督的共同治理格局。

  二、工(gong)作任务

  (一)健(jian)全褒扬和激励诚信行为(wei)机制

1.探索建立行(xing)政(zheng)(zheng)审批“绿色通(tong)(tong)道”。在办理行(xing)政(zheng)(zheng)许可过程中,对诚信典型和连(lian)续三(san)年无不良信用记录的(de)行(xing)政(zheng)(zheng)相对人,可根(gen)据实际(ji)情况实施(shi)“绿色通(tong)(tong)道”和“容缺受理”等便利服务措施(shi)。对符合条件的(de)行(xing)政(zheng)(zheng)相对人,除(chu)法(fa)律法(fa)规(gui)要(yao)求提供(gong)的(de)材(cai)料(liao)外,部分(fen)申(shen)报(bao)材(cai)料(liao)不齐备的(de),如其书面承诺在规(gui)定(ding)期限内提供(gong),应先行(xing)受理,加快(kuai)办理进度。(责(ze)任单位(wei):中、省、市(shi)直(zhi)有关单位(wei),各县〔市(shi)〕、区政(zheng)(zheng)府)

2.优先提(ti)(ti)供公共服务便利(li)(li)。在实(shi)施(shi)财(cai)政(zheng)性资金项目(mu)安排、招商引(yin)资配套优惠(hui)政(zheng)策(ce)(ce)等各(ge)类政(zheng)府(fu)优惠(hui)政(zheng)策(ce)(ce)中,优先考虑诚(cheng)信市(shi)(shi)(shi)(shi)场(chang)(chang)主(zhu)体,加(jia)大扶持力度。在教育、就业、创业、医(yi)疗卫生、社会(hui)保(bao)障等领域对(dui)诚(cheng)信个人(ren)给予重点支持和优先便利(li)(li)。在有(you)关公共资源交(jiao)易活动中,提(ti)(ti)倡依法(fa)依约对(dui)诚(cheng)信市(shi)(shi)(shi)(shi)场(chang)(chang)主(zhu)体采取(qu)信用加(jia)分等措施(shi)。(责任单(dan)位:市(shi)(shi)(shi)(shi)发改(gai)委(wei)、市(shi)(shi)(shi)(shi)财(cai)政(zheng)局(ju)〔国资办〕、市(shi)(shi)(shi)(shi)商务局(ju)、市(shi)(shi)(shi)(shi)教育局(ju)、市(shi)(shi)(shi)(shi)人(ren)社局(ju)、市(shi)(shi)(shi)(shi)卫计委(wei)、市(shi)(shi)(shi)(shi)住建(jian)局(ju)、市(shi)(shi)(shi)(shi)国土资源局(ju)、市(shi)(shi)(shi)(shi)交(jiao)通(tong)运输局(ju)、市(shi)(shi)(shi)(shi)水务局(ju)、市(shi)(shi)(shi)(shi)水文局(ju)、市(shi)(shi)(shi)(shi)工商局(ju),各(ge)县〔市(shi)(shi)(shi)(shi)〕、区政(zheng)府(fu))

3.优化(hua)诚(cheng)信企业行政监(jian)管(guan)安排。各级市(shi)场(chang)监(jian)管(guan)部门(men)应根(gen)据监(jian)管(guan)对象的信用(yong)记录和(he)信用(yong)评价分类,注重运用(yong)大数据手段,完(wan)善事(shi)中事(shi)后(hou)监(jian)管(guan)措施,为市(shi)场(chang)主体提供便利化(hua)服务。对符合一定条件的诚(cheng)信企业,在日常检(jian)查(cha)、专项检(jian)查(cha)中优化(hua)检(jian)查(cha)频(pin)次。(责任单位:中、省、市(shi)直有关(guan)单位,各县〔市(shi)〕、区政府(fu))

4.降低(di)市(shi)场(chang)交易(yi)成本(ben)。鼓励有关部门和(he)单位开发“税易(yi)贷(dai)”、“信(xin)易(yi)贷(dai)”、“信(xin)易(yi)债”等守(shou)信(xin)激励产品。引(yin)导征信(xin)机(ji)(ji)构(gou)加强对市(shi)场(chang)主体正(zheng)面信(xin)息的采集(ji),对守(shou)信(xin)者加大激励性(xing)评分(fen)(fen)比重。引(yin)导金融机(ji)(ji)构(gou)和(he)商业销售机(ji)(ji)构(gou)等市(shi)场(chang)服务机(ji)(ji)构(gou)参考使用市(shi)场(chang)主体信(xin)用信(xin)息、信(xin)用积分(fen)(fen)和(he)信(xin)用评价结果,对诚信(xin)市(shi)场(chang)主体给(ji)予优(you)惠和(he)便利,使守(shou)信(xin)者在市(shi)场(chang)中(zhong)获得更多机(ji)(ji)会和(he)实惠。(责(ze)任(ren)单位:市(shi)金融办(ban)、市(shi)地(di)税局、市(shi)国(guo)税局、人民(min)银(yin)行(xing)伊春(chun)市(shi)中(zhong)心支行(xing)、伊春(chun)银(yin)监分(fen)(fen)局,各县〔市(shi)〕、区(qu)政府)

5.大力推(tui)(tui)介诚(cheng)(cheng)信(xin)(xin)(xin)(xin)(xin)(xin)典型(xing)。将(jiang)有关部门(men)和(he)(he)社会组(zu)织(zhi)实施信(xin)(xin)(xin)(xin)(xin)(xin)用(yong)分类(lei)监管确定(ding)的(de)信(xin)(xin)(xin)(xin)(xin)(xin)用(yong)状况良(liang)(liang)好的(de)行政(zheng)(zheng)相对人、诚(cheng)(cheng)信(xin)(xin)(xin)(xin)(xin)(xin)道德模范(fan)、优(you)秀青年志愿者(zhe),行业协会商会推(tui)(tui)荐的(de)诚(cheng)(cheng)信(xin)(xin)(xin)(xin)(xin)(xin)会员,新闻媒(mei)体挖掘的(de)诚(cheng)(cheng)信(xin)(xin)(xin)(xin)(xin)(xin)主体等(deng)树立(li)为诚(cheng)(cheng)信(xin)(xin)(xin)(xin)(xin)(xin)典型(xing)。鼓励有关部门(men)和(he)(he)社会组(zu)织(zhi)在监管和(he)(he)服务中建立(li)各类(lei)主体信(xin)(xin)(xin)(xin)(xin)(xin)用(yong)记(ji)(ji)录(lu),向社会推(tui)(tui)介无不(bu)良(liang)(liang)信(xin)(xin)(xin)(xin)(xin)(xin)用(yong)记(ji)(ji)录(lu)者(zhe)和(he)(he)有关诚(cheng)(cheng)信(xin)(xin)(xin)(xin)(xin)(xin)典型(xing),联合其他(ta)部门(men)和(he)(he)社会组(zu)织(zhi)实施守信(xin)(xin)(xin)(xin)(xin)(xin)激(ji)励。各级(ji)政(zheng)(zheng)府部门(men)应将(jiang)诚(cheng)(cheng)信(xin)(xin)(xin)(xin)(xin)(xin)典型(xing)优(you)良(liang)(liang)信(xin)(xin)(xin)(xin)(xin)(xin)用(yong)信(xin)(xin)(xin)(xin)(xin)(xin)息及时在政(zheng)(zheng)府网(wang)站(zhan)和(he)(he)“信(xin)(xin)(xin)(xin)(xin)(xin)用(yong)伊春”网(wang)站(zhan)进行公(gong)示,在哈洽会、中俄博(bo)览会、绿色有机食品博(bo)览会、森博(bo)会等(deng)会展活动以(yi)及银(yin)企对接等(deng)活动中重(zhong)点(dian)推(tui)(tui)介诚(cheng)(cheng)信(xin)(xin)(xin)(xin)(xin)(xin)企业,让(rang)信(xin)(xin)(xin)(xin)(xin)(xin)用(yong)成为市(shi)场配置资源(yuan)的(de)重(zhong)要考量因素。(责任(ren)单(dan)位(wei):市(shi)委宣传(chuan)部、市(shi)文明办、团(tuan)市(shi)委、市(shi)工商局、市(shi)工信(xin)(xin)(xin)(xin)(xin)(xin)委、市(shi)金(jin)融办、市(shi)民政(zheng)(zheng)局、市(shi)商务局,各县〔市(shi)〕、区政(zheng)(zheng)府)

  (二(er))健全约束和惩戒失信行(xing)为机制

7.依法(fa)(fa)依规(gui)加强对(dui)(dui)(dui)失(shi)信(xin)行为(wei)(wei)的(de)(de)行政性约束(shu)和(he)(he)惩戒(jie)。对(dui)(dui)(dui)被(bei)列(lie)入经营异常名录、严(yan)(yan)重(zhong)违(wei)法(fa)(fa)失(shi)信(xin)企业(ye)(ye)(ye)(ye)、失(shi)信(xin)被(bei)执(zhi)行人(ren)(ren)(ren)(ren)(ren)(ren)、重(zhong)大税(shui)(shui)收违(wei)法(fa)(fa)案件当事(shi)(shi)(shi)人(ren)(ren)(ren)(ren)(ren)(ren)、违(wei)法(fa)(fa)上(shang)市(shi)(shi)公司相关(guan)责(ze)任主(zhu)体(ti)(ti)、安全(quan)生(sheng)产领域失(shi)信(xin)生(sheng)产经营单位及其(qi)有(you)关(guan)人(ren)(ren)(ren)(ren)(ren)(ren)员(yuan)等严(yan)(yan)重(zhong)失(shi)信(xin)主(zhu)体(ti)(ti),各(ge)地(di)、各(ge)有(you)关(guan)部门应将(jiang)其(qi)列(lie)为(wei)(wei)重(zhong)点监管对(dui)(dui)(dui)象,依法(fa)(fa)依规(gui)采取(qu)行政性约束(shu)和(he)(he)惩戒(jie)措施。从严(yan)(yan)审(shen)核行政许(xu)可(ke)审(shen)批(pi)项(xiang)目,从严(yan)(yan)控制(zhi)生(sheng)产许(xu)可(ke)证发(fa)放,限制(zhi)新增项(xiang)目审(shen)批(pi)、核准(zhun),限制(zhi)股(gu)票发(fa)行上(shang)市(shi)(shi)融(rong)资(zi)(zi)(zi)或发(fa)行债券,限制(zhi)发(fa)起(qi)设立或参股(gu)金(jin)融(rong)机构以及小额贷款公司、融(rong)资(zi)(zi)(zi)担保公司、创业(ye)(ye)(ye)(ye)投(tou)资(zi)(zi)(zi)公司、互(hu)联网融(rong)资(zi)(zi)(zi)平台等机构,限制(zhi)从事(shi)(shi)(shi)互(hu)联网信(xin)息(xi)服(fu)务(wu)等。严(yan)(yan)格(ge)限制(zhi)申请财政性资(zi)(zi)(zi)金(jin)项(xiang)目,限制(zhi)参与(yu)有(you)关(guan)公共资(zi)(zi)(zi)源交易(yi)活(huo)动,限制(zhi)参与(yu)基础设施和(he)(he)公用事(shi)(shi)(shi)业(ye)(ye)(ye)(ye)特许(xu)经营。对(dui)(dui)(dui)事(shi)(shi)(shi)权在国(guo)家(jia)和(he)(he)省(sheng)相关(guan)部门的(de)(de)惩戒(jie)事(shi)(shi)(shi)项(xiang),在向国(guo)家(jia)和(he)(he)省(sheng)申报时(shi),注(zhu)明失(shi)信(xin)情况,建议国(guo)家(jia)和(he)(he)省(sheng)审(shen)慎对(dui)(dui)(dui)待。对(dui)(dui)(dui)严(yan)(yan)重(zhong)失(shi)信(xin)企业(ye)(ye)(ye)(ye)及其(qi)法(fa)(fa)定(ding)代表(biao)人(ren)(ren)(ren)(ren)(ren)(ren)、主(zhu)要负(fu)责(ze)人(ren)(ren)(ren)(ren)(ren)(ren)和(he)(he)对(dui)(dui)(dui)失(shi)信(xin)行为(wei)(wei)负(fu)有(you)直(zhi)接(jie)责(ze)任的(de)(de)注(zhu)册执(zhi)业(ye)(ye)(ye)(ye)人(ren)(ren)(ren)(ren)(ren)(ren)员(yuan)等实施市(shi)(shi)场和(he)(he)行业(ye)(ye)(ye)(ye)禁(jin)入措施。被(bei)列(lie)入严(yan)(yan)重(zhong)违(wei)法(fa)(fa)失(shi)信(xin)企业(ye)(ye)(ye)(ye)名单的(de)(de)企业(ye)(ye)(ye)(ye)的(de)(de)法(fa)(fa)定(ding)代表(biao)人(ren)(ren)(ren)(ren)(ren)(ren)、负(fu)责(ze)人(ren)(ren)(ren)(ren)(ren)(ren),3年内不得担任其(qi)他企业(ye)(ye)(ye)(ye)的(de)(de)法(fa)(fa)定(ding)代表(biao)人(ren)(ren)(ren)(ren)(ren)(ren)、负(fu)责(ze)人(ren)(ren)(ren)(ren)(ren)(ren)。及时(shi)撤销严(yan)(yan)重(zhong)失(shi)信(xin)企业(ye)(ye)(ye)(ye)及其(qi)法(fa)(fa)定(ding)代表(biao)人(ren)(ren)(ren)(ren)(ren)(ren)、负(fu)责(ze)人(ren)(ren)(ren)(ren)(ren)(ren)、高级管理人(ren)(ren)(ren)(ren)(ren)(ren)员(yuan)和(he)(he)对(dui)(dui)(dui)失(shi)信(xin)行为(wei)(wei)负(fu)有(you)直(zhi)接(jie)责(ze)任的(de)(de)董(dong)事(shi)(shi)(shi)、股(gu)东(dong)等人(ren)(ren)(ren)(ren)(ren)(ren)员(yuan)的(de)(de)荣誉(yu)称号,取(qu)消参加评先(xian)评优(you)资(zi)(zi)(zi)格(ge)。(责(ze)任单位:市(shi)(shi)工(gong)商(shang)局、市(shi)(shi)法(fa)(fa)院、市(shi)(shi)地(di)税(shui)(shui)局、市(shi)(shi)国(guo)税(shui)(shui)局、市(shi)(shi)安监局、市(shi)(shi)发(fa)改(gai)委(wei)、市(shi)(shi)工(gong)信(xin)委(wei)、市(shi)(shi)金(jin)融(rong)办、市(shi)(shi)财政局、市(shi)(shi)质监局,各(ge)县(xian)〔市(shi)(shi)〕、区政府)

8.加强对(dui)(dui)(dui)(dui)失(shi)信(xin)(xin)(xin)行(xing)(xing)(xing)(xing)(xing)为(wei)(wei)(wei)的市(shi)(shi)场性约束(shu)和惩戒。对(dui)(dui)(dui)(dui)严(yan)(yan)重失(shi)信(xin)(xin)(xin)主(zhu)体,有(you)关(guan)部门(men)和机(ji)(ji)(ji)构(gou)应以(yi)统一社会信(xin)(xin)(xin)用(yong)(yong)代码为(wei)(wei)(wei)索引,及时公开披露相关(guan)信(xin)(xin)(xin)息,便于市(shi)(shi)场识别失(shi)信(xin)(xin)(xin)行(xing)(xing)(xing)(xing)(xing)为(wei)(wei)(wei),防范信(xin)(xin)(xin)用(yong)(yong)风(feng)险(xian)(xian)。督促有(you)关(guan)企业和个(ge)人履(lv)行(xing)(xing)(xing)(xing)(xing)法定(ding)义务,对(dui)(dui)(dui)(dui)有(you)履(lv)行(xing)(xing)(xing)(xing)(xing)能力但拒不履(lv)行(xing)(xing)(xing)(xing)(xing)的严(yan)(yan)重失(shi)信(xin)(xin)(xin)主(zhu)体实施限制出境和限制购买不动产(chan)、乘坐(zuo)飞机(ji)(ji)(ji)、乘坐(zuo)高(gao)等级列车和席次、旅游度(du)假(jia)、入住星级以(yi)上宾馆(guan)及其他高(gao)消费行(xing)(xing)(xing)(xing)(xing)为(wei)(wei)(wei)等措施。支持(chi)征(zheng)信(xin)(xin)(xin)机(ji)(ji)(ji)构(gou)采集(ji)严(yan)(yan)重失(shi)信(xin)(xin)(xin)行(xing)(xing)(xing)(xing)(xing)为(wei)(wei)(wei)信(xin)(xin)(xin)息,纳入信(xin)(xin)(xin)用(yong)(yong)记录和信(xin)(xin)(xin)用(yong)(yong)报告。引导商业银(yin)行(xing)(xing)(xing)(xing)(xing)、证(zheng)券期货经(jing)营机(ji)(ji)(ji)构(gou)、保(bao)险(xian)(xian)公司等金(jin)融机(ji)(ji)(ji)构(gou)按(an)照风(feng)险(xian)(xian)定(ding)价(jia)原则(ze),对(dui)(dui)(dui)(dui)严(yan)(yan)重失(shi)信(xin)(xin)(xin)主(zhu)体提(ti)高(gao)贷款(kuan)利率和财产(chan)保(bao)险(xian)(xian)费率,或者限制向其提(ti)供贷款(kuan)、保(bao)荐、承销、保(bao)险(xian)(xian)等服务。(责任单位:市(shi)(shi)法院、市(shi)(shi)公安局、市(shi)(shi)住建局、伊春林都机(ji)(ji)(ji)场、伊春铁路车站、市(shi)(shi)旅发委、人民(min)银(yin)行(xing)(xing)(xing)(xing)(xing)伊春市(shi)(shi)中心支行(xing)(xing)(xing)(xing)(xing)、伊春银(yin)监分(fen)局,各(ge)县〔市(shi)(shi)〕、区政府)

9.加强对(dui)失(shi)(shi)信(xin)(xin)行(xing)(xing)(xing)为的(de)行(xing)(xing)(xing)业(ye)性(xing)约束和惩戒(jie)。建(jian)立健全(quan)行(xing)(xing)(xing)业(ye)自(zi)律公约和职业(ye)道德准(zhun)则(ze),推动行(xing)(xing)(xing)业(ye)信(xin)(xin)用(yong)建(jian)设。引导行(xing)(xing)(xing)业(ye)协(xie)会(hui)(hui)商会(hui)(hui)完善行(xing)(xing)(xing)业(ye)内部信(xin)(xin)用(yong)信(xin)(xin)息采集、共(gong)享机制,将严重(zhong)失(shi)(shi)信(xin)(xin)行(xing)(xing)(xing)为记入会(hui)(hui)员信(xin)(xin)用(yong)档案。鼓(gu)励(li)行(xing)(xing)(xing)业(ye)协(xie)会(hui)(hui)商会(hui)(hui)与(yu)有资质的(de)第三方(fang)信(xin)(xin)用(yong)服务机构合作,开(kai)展(zhan)会(hui)(hui)员企业(ye)信(xin)(xin)用(yong)等级评(ping)价。支(zhi)持行(xing)(xing)(xing)业(ye)协(xie)会(hui)(hui)商会(hui)(hui)按照行(xing)(xing)(xing)业(ye)标准(zhun)、行(xing)(xing)(xing)规、行(xing)(xing)(xing)约等,视情节轻重(zhong)对(dui)失(shi)(shi)信(xin)(xin)会(hui)(hui)员实行(xing)(xing)(xing)警告、行(xing)(xing)(xing)业(ye)内通报批评(ping)、公开(kai)谴(qian)责、不(bu)予接纳、劝退(tui)等惩戒(jie)措施(shi)。(责任单位:中(zhong)、省、市直(zhi)有关单位,各县〔市〕、区(qu)政府)

10.加强对失信(xin)行(xing)为的(de)社会(hui)性(xing)约束(shu)和惩戒(jie)。引导社会(hui)力量广泛参(can)与(yu)失信(xin)联合(he)(he)惩戒(jie)。建立完善失信(xin)举报(bao)制度,鼓励公(gong)众举报(bao)企业(ye)严重(zhong)失信(xin)行(xing)为,对举报(bao)人信(xin)息严格保密(mi)。鼓励公(gong)正(zheng)、独立、有条件的(de)社会(hui)机(ji)构开展失信(xin)行(xing)为大数据舆情监测,编制发(fa)布地区、行(xing)业(ye)信(xin)用分析报(bao)告。充分发(fa)挥(hui)各(ge)类社会(hui)组织作用,支持有关(guan)社会(hui)组织依法对污(wu)染环境(jing)、侵(qin)害(hai)消(xiao)费者或公(gong)众投资(zi)者合(he)(he)法权(quan)益(yi)等群体性(xing)侵(qin)权(quan)行(xing)为提(ti)起公(gong)益(yi)诉(su)讼。(责任(ren)单位:市(shi)工商局、市(shi)民政局、市(shi)环保局、市(shi)公(gong)安局,各(ge)县(xian)〔市(shi)〕、区政府(fu))

11.完善个(ge)人(ren)(ren)信(xin)用记(ji)(ji)录(lu),推(tui)动(dong)联合惩(cheng)戒(jie)(jie)措(cuo)施(shi)落(luo)实到(dao)人(ren)(ren)。对(dui)企(qi)事(shi)业单(dan)位(wei)(wei)(wei)严重失(shi)信(xin)行为,在记(ji)(ji)入企(qi)事(shi)业单(dan)位(wei)(wei)(wei)信(xin)用记(ji)(ji)录(lu)的(de)同时,记(ji)(ji)入其法定代表人(ren)(ren)、主要负(fu)责(ze)人(ren)(ren)和其他(ta)负(fu)有直接(jie)责(ze)任人(ren)(ren)员的(de)个(ge)人(ren)(ren)信(xin)用记(ji)(ji)录(lu)。在对(dui)失(shi)信(xin)企(qi)事(shi)业单(dan)位(wei)(wei)(wei)进行联合惩(cheng)戒(jie)(jie)的(de)同时,依照(zhao)法律(lv)法规和政策规定对(dui)相关责(ze)任人(ren)(ren)员采取相应的(de)联合惩(cheng)戒(jie)(jie)措(cuo)施(shi)。通过建立完整的(de)个(ge)人(ren)(ren)信(xin)用记(ji)(ji)录(lu)数(shu)据库及联合惩(cheng)戒(jie)(jie)机(ji)制(zhi),使失(shi)信(xin)惩(cheng)戒(jie)(jie)措(cuo)施(shi)落(luo)实到(dao)人(ren)(ren)。(责(ze)任单(dan)位(wei)(wei)(wei):市(shi)编委办、市(shi)人(ren)(ren)社(she)局(ju)、市(shi)工商(shang)局(ju)、市(shi)公安局(ju),各县〔市(shi)〕、区(qu)政府)

14.规(gui)(gui)范信用(yong)(yong)红(hong)黑名(ming)(ming)单(dan)制(zhi)(zhi)度。不断完善诚信典(dian)型“红(hong)名(ming)(ming)单(dan)”制(zhi)(zhi)度和(he)(he)严重失信主体“黑名(ming)(ming)单(dan)”制(zhi)(zhi)度,依法(fa)依规(gui)(gui)规(gui)(gui)范各领域红(hong)黑名(ming)(ming)单(dan)产(chan)生和(he)(he)发布行为,建立健全(quan)退出(chu)机(ji)制(zhi)(zhi)。在保证(zheng)独立、公正、客观前提下(xia),鼓励(li)有关群众(zhong)团体、金融机(ji)构、征信机(ji)构、评级机(ji)构、行业协会商会等将产(chan)生的“红(hong)名(ming)(ming)单(dan)”和(he)(he)“黑名(ming)(ming)单(dan)”信息提供给政府部门(men)参考使用(yong)(yong)。(责任单(dan)位:中、省、市直有关单(dan)位,各县(xian)〔市〕、区政府)

15.建立(li)健全信(xin)用(yong)(yong)修(xiu)复(fu)机制(zhi)。联(lian)合(he)惩戒措施(shi)的发起部(bu)门和(he)实(shi)施(shi)部(bu)门应按照(zhao)法律法规(gui)和(he)政策(ce)规(gui)定明确各类失(shi)信(xin)行(xing)为的联(lian)合(he)惩戒期(qi)限。在规(gui)定期(qi)限内纠正失(shi)信(xin)行(xing)为、消除(chu)不良(liang)影响的,不再作为联(lian)合(he)惩戒对(dui)象。建立(li)有(you)利于(yu)自我纠错(cuo)、主(zhu)动自新的社会鼓励与关(guan)爱机制(zhi),支持有(you)失(shi)信(xin)行(xing)为的个人通过社会公益(yi)服(fu)务(wu)等方式修(xiu)复(fu)个人信(xin)用(yong)(yong)。(责任单位(wei):中、省、市直有(you)关(guan)单位(wei))

16.建立健全信(xin)(xin)(xin)(xin)用(yong)主(zhu)(zhu)(zhu)体权(quan)益(yi)保护机制。建立健全信(xin)(xin)(xin)(xin)用(yong)信(xin)(xin)(xin)(xin)息(xi)异议(yi)、投诉(su)制度。有(you)关(guan)部门(men)和单(dan)位(wei)(wei)在(zai)执行失信(xin)(xin)(xin)(xin)联合(he)(he)(he)惩(cheng)戒措(cuo)(cuo)施(shi)时(shi)(shi)主(zhu)(zhu)(zhu)动发现(xian)、经(jing)市场(chang)主(zhu)(zhu)(zhu)体提出(chu)异议(yi)申请或(huo)投诉(su)发现(xian)信(xin)(xin)(xin)(xin)息(xi)不(bu)实(shi)的(de),应(ying)及时(shi)(shi)告知信(xin)(xin)(xin)(xin)息(xi)提供(gong)单(dan)位(wei)(wei)核(he)(he)实(shi),信(xin)(xin)(xin)(xin)息(xi)提供(gong)单(dan)位(wei)(wei)应(ying)尽快核(he)(he)实(shi)并反馈。联合(he)(he)(he)惩(cheng)戒措(cuo)(cuo)施(shi)在(zai)信(xin)(xin)(xin)(xin)息(xi)核(he)(he)实(shi)期间暂不(bu)执行。经(jing)核(he)(he)实(shi)有(you)误(wu)的(de)信(xin)(xin)(xin)(xin)息(xi)应(ying)及时(shi)(shi)更正(zheng)或(huo)撤销。因错误(wu)采取联合(he)(he)(he)惩(cheng)戒措(cuo)(cuo)施(shi)损(sun)害(hai)有(you)关(guan)主(zhu)(zhu)(zhu)体合(he)(he)(he)法权(quan)益(yi)的(de),有(you)关(guan)部门(men)和单(dan)位(wei)(wei)应(ying)积极采取措(cuo)(cuo)施(shi)恢复(fu)(fu)其信(xin)(xin)(xin)(xin)誉、消除不(bu)良(liang)影(ying)响(xiang)。支持(chi)有(you)关(guan)主(zhu)(zhu)(zhu)体通过行政(zheng)复(fu)(fu)议(yi)、行政(zheng)诉(su)讼等方式维护自身(shen)合(he)(he)(he)法权(quan)益(yi)。(责任单(dan)位(wei)(wei):中、省、市直(zhi)有(you)关(guan)单(dan)位(wei)(wei))

  (四)加强(qiang)法(fa)规制(zhi)度和诚信文化建设

17.建立完善相关地方性法(fa)规(gui)、政(zheng)府(fu)(fu)规(gui)章和(he)规(gui)范(fan)(fan)标准。加快研究推进信(xin)(xin)用信(xin)(xin)息(xi)(xi)归集、共享、公开和(he)使(shi)用,以及(ji)(ji)(ji)失信(xin)(xin)行为联合(he)惩戒等方面的立法(fa)工(gong)作,对现行政(zheng)府(fu)(fu)规(gui)章和(he)规(gui)范(fan)(fan)性文件及(ji)(ji)(ji)时调整修订。按要求统一(yi)各部(bu)门(men)与黑龙江省信(xin)(xin)用信(xin)(xin)息(xi)(xi)共享交(jiao)换平(ping)台(tai)间的数据格式、数据接口,动态更新信(xin)(xin)用信(xin)(xin)息(xi)(xi)征集目录。(责任单位:市(shi)(shi)工(gong)商局(ju)及(ji)(ji)(ji)中、省、市(shi)(shi)直(zhi)有关单位,各县〔市(shi)(shi)〕、区政(zheng)府(fu)(fu))

18.加(jia)强(qiang)诚(cheng)(cheng)信(xin)(xin)教(jiao)(jiao)育和(he)(he)(he)(he)诚(cheng)(cheng)信(xin)(xin)文化建(jian)设(she)(she)。组织社(she)会(hui)(hui)各(ge)方面力(li)(li)量,引导广(guang)大(da)(da)市(shi)(shi)(shi)(shi)(shi)(shi)场主体(ti)(ti)依法诚(cheng)(cheng)信(xin)(xin)经营和(he)(he)(he)(he)主动发布(bu)综合信(xin)(xin)用承诺或产(chan)(chan)品(pin)(pin)服(fu)务质(zhi)量等专项承诺,开(kai)展(zhan)产(chan)(chan)品(pin)(pin)服(fu)务标准(zhun)等自我(wo)声(sheng)明(ming)公开(kai)。树立“诚(cheng)(cheng)信(xin)(xin)兴商”理(li)念,组织新闻媒体(ti)(ti)多(duo)渠道宣(xuan)传诚(cheng)(cheng)信(xin)(xin)企业(ye)和(he)(he)(he)(he)个人(ren)(ren),营造浓(nong)厚(hou)社(she)会(hui)(hui)氛围(wei)。推动行(xing)业(ye)协(xie)会(hui)(hui)商会(hui)(hui)加(jia)强(qiang)诚(cheng)(cheng)信(xin)(xin)建(jian)设(she)(she)和(he)(he)(he)(he)行(xing)业(ye)自律,表彰诚(cheng)(cheng)信(xin)(xin)会(hui)(hui)员,讲好行(xing)业(ye)“诚(cheng)(cheng)信(xin)(xin)故事”。加(jia)强(qiang)对(dui)(dui)失(shi)(shi)信(xin)(xin)行(xing)为(wei)的(de)道德约束,完善社(she)会(hui)(hui)舆论(lun)监(jian)(jian)督(du)(du)机制,通过报刊、广(guang)播、电视、网络等媒体(ti)(ti)加(jia)大(da)(da)对(dui)(dui)失(shi)(shi)信(xin)(xin)主体(ti)(ti)的(de)监(jian)(jian)督(du)(du)力(li)(li)度(du),依法曝光社(she)会(hui)(hui)影响恶劣、情节严重(zhong)(zhong)的(de)失(shi)(shi)信(xin)(xin)案件,开(kai)展(zhan)群(qun)(qun)众评议、讨论(lun)、批评等活动,形成对(dui)(dui)严重(zhong)(zhong)失(shi)(shi)信(xin)(xin)行(xing)为(wei)的(de)舆论(lun)压力(li)(li)和(he)(he)(he)(he)道德约束。通过学校(xiao)、单位、社(she)区(qu)、家庭等,加(jia)强(qiang)对(dui)(dui)失(shi)(shi)信(xin)(xin)个人(ren)(ren)的(de)教(jiao)(jiao)育和(he)(he)(he)(he)帮助,引导其(qi)及(ji)时纠正失(shi)(shi)信(xin)(xin)行(xing)为(wei)。加(jia)强(qiang)对(dui)(dui)企业(ye)负责(ze)人(ren)(ren)、学生(sheng)和(he)(he)(he)(he)青年群(qun)(qun)体(ti)(ti)的(de)诚(cheng)(cheng)信(xin)(xin)宣(xuan)传教(jiao)(jiao)育,加(jia)强(qiang)会(hui)(hui)计(ji)审计(ji)人(ren)(ren)员、导游、保险经纪人(ren)(ren)、公职人(ren)(ren)员等重(zhong)(zhong)点(dian)人(ren)(ren)群(qun)(qun)以(yi)诚(cheng)(cheng)信(xin)(xin)为(wei)重(zhong)(zhong)要内容的(de)职业(ye)道德建(jian)设(she)(she)。各(ge)级政府部(bu)门(men)在实施守信(xin)(xin)联(lian)合激励和(he)(he)(he)(he)失(shi)(shi)信(xin)(xin)联(lian)合惩戒(jie)过程中,重(zhong)(zhong)点(dian)挖掘整(zheng)理(li)工商、税务、金融(rong)、食(shi)品(pin)(pin)药(yao)品(pin)(pin)安全、质(zhi)量安全、特种设(she)(she)备安全、安全生(sheng)产(chan)(chan)、证券(quan)监(jian)(jian)管、环(huan)(huan)境保护(hu)以(yi)及(ji)司法等关系到人(ren)(ren)民群(qun)(qun)众切身(shen)利益和(he)(he)(he)(he)生(sheng)命(ming)财(cai)产(chan)(chan)安全的(de)重(zhong)(zhong)点(dian)领域典型(xing)案例,定期(qi)报送至(zhi)省信(xin)(xin)用信(xin)(xin)息共享交换(huan)平台。加(jia)大(da)(da)对(dui)(dui)守信(xin)(xin)联(lian)合激励和(he)(he)(he)(he)失(shi)(shi)信(xin)(xin)联(lian)合惩戒(jie)的(de)宣(xuan)传报道和(he)(he)(he)(he)案例剖析力(li)(li)度(du),弘(hong)扬社(she)会(hui)(hui)主义核心价(jia)值观。(责(ze)任单位:市(shi)(shi)(shi)(shi)(shi)(shi)委(wei)宣(xuan)传部(bu)、市(shi)(shi)(shi)(shi)(shi)(shi)文明(ming)办、团市(shi)(shi)(shi)(shi)(shi)(shi)委(wei)、市(shi)(shi)(shi)(shi)(shi)(shi)教(jiao)(jiao)育局(ju)(ju)、市(shi)(shi)(shi)(shi)(shi)(shi)财(cai)政局(ju)(ju)、市(shi)(shi)(shi)(shi)(shi)(shi)人(ren)(ren)社(she)局(ju)(ju)、市(shi)(shi)(shi)(shi)(shi)(shi)环(huan)(huan)保局(ju)(ju)、市(shi)(shi)(shi)(shi)(shi)(shi)公安局(ju)(ju)、市(shi)(shi)(shi)(shi)(shi)(shi)工商局(ju)(ju)、市(shi)(shi)(shi)(shi)(shi)(shi)旅游局(ju)(ju)、市(shi)(shi)(shi)(shi)(shi)(shi)地(di)税局(ju)(ju)、市(shi)(shi)(shi)(shi)(shi)(shi)国(guo)税局(ju)(ju)、人(ren)(ren)民银行(xing)伊春市(shi)(shi)(shi)(shi)(shi)(shi)中心支行(xing)、市(shi)(shi)(shi)(shi)(shi)(shi)食(shi)品(pin)(pin)药(yao)品(pin)(pin)监(jian)(jian)管局(ju)(ju)、市(shi)(shi)(shi)(shi)(shi)(shi)安监(jian)(jian)局(ju)(ju)、市(shi)(shi)(shi)(shi)(shi)(shi)法院,各(ge)县〔市(shi)(shi)(shi)(shi)(shi)(shi)〕、区(qu)政府)

  三、保障措施

  (一)加强(qiang)(qiang)组织(zhi)实(shi)(shi)施(shi)。各(ge)地(di)、各(ge)有关部(bu)(bu)门(men)要把实(shi)(shi)施(shi)守(shou)(shou)信(xin)联(lian)合(he)(he)激(ji)励(li)(li)和(he)(he)失(shi)(shi)信(xin)联(lian)合(he)(he)惩(cheng)戒(jie)(jie)(jie)作(zuo)为(wei)推进社会信(xin)用(yong)体系(xi)建(jian)设的重要举(ju)措(cuo),认真贯彻落(luo)实(shi)(shi)本方(fang)(fang)案并(bing)制(zhi)(zhi)(zhi)定具体措(cuo)施(shi),切实(shi)(shi)加强(qiang)(qiang)组织(zhi)领导(dao),建(jian)立完善(shan)信(xin)用(yong)联(lian)合(he)(he)激(ji)励(li)(li)惩(cheng)戒(jie)(jie)(jie)工(gong)作(zuo)的各(ge)项制(zhi)(zhi)(zhi)度,落(luo)实(shi)(shi)工(gong)作(zuo)机构、人员编制(zhi)(zhi)(zhi)、项目经费(fei)等(deng)必(bi)要保(bao)障,确保(bao)各(ge)项联(lian)合(he)(he)激(ji)励(li)(li)和(he)(he)联(lian)合(he)(he)惩(cheng)戒(jie)(jie)(jie)措(cuo)施(shi)落(luo)实(shi)(shi)到(dao)位。建(jian)立守(shou)(shou)信(xin)联(lian)合(he)(he)激(ji)励(li)(li)和(he)(he)失(shi)(shi)信(xin)联(lian)合(he)(he)惩(cheng)戒(jie)(jie)(jie)的发(fa)起与响应(ying)机制(zhi)(zhi)(zhi),各(ge)领域守(shou)(shou)信(xin)联(lian)合(he)(he)激(ji)励(li)(li)和(he)(he)失(shi)(shi)信(xin)联(lian)合(he)(he)惩(cheng)戒(jie)(jie)(jie)的发(fa)起部(bu)(bu)门(men)负责(ze)确定激(ji)励(li)(li)和(he)(he)惩(cheng)戒(jie)(jie)(jie)对(dui)象,实(shi)(shi)施(shi)部(bu)(bu)门(men)负责(ze)对(dui)有关主体采取相(xiang)应(ying)的联(lian)合(he)(he)激(ji)励(li)(li)和(he)(he)联(lian)合(he)(he)惩(cheng)戒(jie)(jie)(jie)措(cuo)施(shi)。鼓(gu)励(li)(li)有关地(di)区(qu)和(he)(he)部(bu)(bu)门(men)先行先试,通过签署合(he)(he)作(zuo)备忘(wang)录(lu)或出(chu)台(tai)规范性文件等(deng)多种方(fang)(fang)式建(jian)立长效机制(zhi)(zhi)(zhi),不断丰富(fu)信(xin)用(yong)激(ji)励(li)(li)内容(rong),强(qiang)(qiang)化信(xin)用(yong)约(yue)束措(cuo)施(shi)。(责(ze)任单位:中(zhong)、省、市直有关单位,各(ge)县(xian)〔市〕、区(qu)政府)

  (二)加强(qiang)跟踪问效。充分利用省信用信息共享交换平(ping)台和“信用伊春”网站,建立健全信用联合激励惩戒的跟踪、监测、统计、评估机制并建立相应的督查、考核制度,将考核结果纳入对各地、各部门年度责任目标考核。对信用信息归集、共享和激励惩戒措施落实不力的部门和单位,进行通报和督促整改,切实把各项联合激励和联合惩戒措施落到实处。市工商局要加强统筹协调,及时跟踪掌握工作进展,督促检查任务落实情况并报告市政府。市政府将对本方案的贯彻落实情况适时开展专项督查。(责任单位:市政府办、市工商局,各县〔市〕、区政府)
