黑龙江省人民政府关于在市场体系建设中建立公平竞争审查制度的通知

  为贯彻落实《国(guo)(guo)务院关于(yu)在市场(chang)体系(xi)建(jian)设(she)(she)中建(jian)立公平(ping)竞争(zheng)(zheng)审查制度的(de)意(yi)见》(国(guo)(guo)发(fa)〔2016〕34号)精神(shen),加快建(jian)立公平(ping)竞争(zheng)(zheng)审查制度,推动统(tong)一开(kai)放、竞争(zheng)(zheng)有序的(de)市场(chang)体系(xi)建(jian)设(she)(she),现将有关事(shi)项通知(zhi)如(ru)下:


  一(yi)、充(chong)(chong)分认识(shi)建(jian)立(li)(li)公(gong)平(ping)竞(jing)(jing)争(zheng)审(shen)(shen)(shen)查(cha)(cha)(cha)制(zhi)(zhi)度(du)(du)的(de)重(zhong)要(yao)(yao)(yao)(yao)意义。公(gong)平(ping)竞(jing)(jing)争(zheng)是市(shi)场(chang)(chang)经(jing)(jing)济(ji)(ji)的(de)基本(ben)原则(ze),是市(shi)场(chang)(chang)机制(zhi)(zhi)高效运行(xing)的(de)重(zhong)要(yao)(yao)(yao)(yao)基础。建(jian)立(li)(li)公(gong)平(ping)竞(jing)(jing)争(zheng)审(shen)(shen)(shen)查(cha)(cha)(cha)制(zhi)(zhi)度(du)(du)是深(shen)入推(tui)进经(jing)(jing)济(ji)(ji)体制(zhi)(zhi)改革的(de)客观需要(yao)(yao)(yao)(yao),是全(quan)面推(tui)进依(yi)法治(zhi)国的(de)有力(li)保(bao)障(zhang),是实现创新驱动(dong)发展的(de)必然选(xuan)择,是释(shi)放市(shi)场(chang)(chang)主体活力(li)的(de)有效举(ju)措(cuo)(cuo)。各地(di)、各部门要(yao)(yao)(yao)(yao)充(chong)(chong)分认识(shi)建(jian)立(li)(li)公(gong)平(ping)竞(jing)(jing)争(zheng)审(shen)(shen)(shen)查(cha)(cha)(cha)制(zhi)(zhi)度(du)(du)的(de)重(zhong)要(yao)(yao)(yao)(yao)性和(he)紧迫性,准(zhun)确(que)把握(wo)建(jian)立(li)(li)公(gong)平(ping)竞(jing)(jing)争(zheng)审(shen)(shen)(shen)查(cha)(cha)(cha)制(zhi)(zhi)度(du)(du)的(de)总体要(yao)(yao)(yao)(yao)求(qiu)和(he)基本(ben)原则(ze),明确(que)公(gong)平(ping)竞(jing)(jing)争(zheng)审(shen)(shen)(shen)查(cha)(cha)(cha)制(zhi)(zhi)度(du)(du)的(de)审(shen)(shen)(shen)查(cha)(cha)(cha)对象、审(shen)(shen)(shen)查(cha)(cha)(cha)方式和(he)审(shen)(shen)(shen)查(cha)(cha)(cha)标准(zhun)等要(yao)(yao)(yao)(yao)求(qiu),主动(dong)开展公(gong)平(ping)竞(jing)(jing)争(zheng)审(shen)(shen)(shen)查(cha)(cha)(cha)工作。要(yao)(yao)(yao)(yao)通过建(jian)立(li)(li)公(gong)平(ping)竞(jing)(jing)争(zheng)审(shen)(shen)(shen)查(cha)(cha)(cha)制(zhi)(zhi)度(du)(du),从(cong)源(yuan)头(tou)上有效规(gui)范(fan)相(xiang)关行(xing)为,防止出(chu)台排(pai)除、限制(zhi)(zhi)竞(jing)(jing)争(zheng)的(de)政策(ce)措(cuo)(cuo)施,逐步清理废除妨碍统一(yi)市(shi)场(chang)(chang)和(he)公(gong)平(ping)竞(jing)(jing)争(zheng)的(de)规(gui)定和(he)做法。要(yao)(yao)(yao)(yao)不断(duan)强(qiang)化(hua)法治(zhi)思(si)维和(he)法治(zhi)方式,牢固树立(li)(li)以法治(zhi)、制(zhi)(zhi)度(du)(du)、规(gui)则(ze)、信用为核心(xin)的(de)市(shi)场(chang)(chang)经(jing)(jing)济(ji)(ji)意识(shi),进一(yi)步优化(hua)全(quan)省发展环境,促进我省经(jing)(jing)济(ji)(ji)持续(xu)健(jian)康发展。


  二、严(yan)(yan)格(ge)落实公(gong)(gong)平竞(jing)(jing)争(zheng)(zheng)(zheng)审查(cha)(cha)(cha)(cha)制(zhi)(zhi)度。省内各级(ji)行(xing)(xing)(xing)政机(ji)关(guan)和(he)法(fa)(fa)律(lv)、法(fa)(fa)规授权的具(ju)有(you)(you)管理(li)公(gong)(gong)共事务职(zhi)能的组织(zhi)(以(yi)下统(tong)称政策(ce)(ce)制(zhi)(zhi)定(ding)(ding)(ding)机(ji)关(guan))制(zhi)(zhi)定(ding)(ding)(ding)市(shi)场准入、产业发展、招商引资(zi)、招标(biao)投标(biao)、政府(fu)采购、经营行(xing)(xing)(xing)为规范(fan)、资(zi)质标(biao)准等(deng)(deng)涉(she)及(ji)市(shi)场主体(ti)经济(ji)活动的规范(fan)性(xing)文件和(he)其他政策(ce)(ce)措(cuo)(cuo)施时,均应(ying)当进(jin)(jin)行(xing)(xing)(xing)公(gong)(gong)平竞(jing)(jing)争(zheng)(zheng)(zheng)审查(cha)(cha)(cha)(cha)。地方(fang)性(xing)法(fa)(fa)规、政府(fu)规章及(ji)政府(fu)制(zhi)(zhi)定(ding)(ding)(ding)的其他政策(ce)(ce)措(cuo)(cuo)施,起(qi)(qi)草(cao)部门应(ying)当在起(qi)(qi)草(cao)过程(cheng)中进(jin)(jin)行(xing)(xing)(xing)公(gong)(gong)平竞(jing)(jing)争(zheng)(zheng)(zheng)审查(cha)(cha)(cha)(cha),未(wei)进(jin)(jin)行(xing)(xing)(xing)自我(wo)审查(cha)(cha)(cha)(cha)的,不得提交审议。政策(ce)(ce)制(zhi)(zhi)定(ding)(ding)(ding)机(ji)关(guan)在政策(ce)(ce)措(cuo)(cuo)施制(zhi)(zhi)定(ding)(ding)(ding)过程(cheng)中,要(yao)严(yan)(yan)格(ge)对照公(gong)(gong)平竞(jing)(jing)争(zheng)(zheng)(zheng)审查(cha)(cha)(cha)(cha)标(biao)准进(jin)(jin)行(xing)(xing)(xing)自我(wo)审查(cha)(cha)(cha)(cha)。经审查(cha)(cha)(cha)(cha)认为不具(ju)有(you)(you)排除、限(xian)制(zhi)(zhi)竞(jing)(jing)争(zheng)(zheng)(zheng)效(xiao)(xiao)果的,可以(yi)实施;具(ju)有(you)(you)排除、限(xian)制(zhi)(zhi)竞(jing)(jing)争(zheng)(zheng)(zheng)效(xiao)(xiao)果的,应(ying)当不予出台,或调整至符合相(xiang)关(guan)要(yao)求后(hou)出台。没(mei)有(you)(you)进(jin)(jin)行(xing)(xing)(xing)公(gong)(gong)平竞(jing)(jing)争(zheng)(zheng)(zheng)审查(cha)(cha)(cha)(cha)的,不得出台。具(ju)体(ti)审查(cha)(cha)(cha)(cha)标(biao)准、审查(cha)(cha)(cha)(cha)方(fang)式、例外规定(ding)(ding)(ding)等(deng)(deng)要(yao)严(yan)(yan)格(ge)按照国发〔2016〕34号文件有(you)(you)关(guan)规定(ding)(ding)(ding)执(zhi)行(xing)(xing)(xing)。


  三、有序组织开展公(gong)平(ping)竞争(zheng)审(shen)(shen)查(cha)工(gong)(gong)作。省政(zheng)(zheng)府(fu)(fu)及(ji)所属部(bu)(bu)(bu)(bu)门自本通知印(yin)发之日起(qi),市(shi)(地(di)(di)(di))、县(市(shi)、区)政(zheng)(zheng)府(fu)(fu)(行署)及(ji)所属部(bu)(bu)(bu)(bu)门自2017年起(qi),在有关政(zheng)(zheng)策(ce)措(cuo)施制(zhi)定(ding)(ding)过程中(zhong)均要(yao)进行公(gong)平(ping)竞争(zheng)审(shen)(shen)查(cha)。其中(zhong),多家联合制(zhi)定(ding)(ding)的(de)政(zheng)(zheng)策(ce)措(cuo)施,由牵头(tou)部(bu)(bu)(bu)(bu)门负责进行审(shen)(shen)查(cha)。按(an)照(zhao)“谁(shei)制(zhi)定(ding)(ding)、谁(shei)清理(li)”的(de)原则,有序清理(li)存量政(zheng)(zheng)策(ce)。各(ge)级政(zheng)(zheng)府(fu)(fu)及(ji)所属部(bu)(bu)(bu)(bu)门要(yao)对(dui)(dui)照(zhao)公(gong)平(ping)竞争(zheng)审(shen)(shen)查(cha)标准(zhun),对(dui)(dui)现行政(zheng)(zheng)策(ce)措(cuo)施区分不同情(qing)况,稳(wen)妥把握节奏(zou),有序清理(li)和(he)(he)废(fei)除妨碍统一(yi)市(shi)场和(he)(he)公(gong)平(ping)竞争(zheng)的(de)各(ge)种(zhong)规(gui)定(ding)(ding)和(he)(he)做(zuo)法,政(zheng)(zheng)府(fu)(fu)制(zhi)定(ding)(ding)的(de)政(zheng)(zheng)策(ce)措(cuo)施由起(qi)草部(bu)(bu)(bu)(bu)门提出(chu)清理(li)意见后(hou)报(bao)政(zheng)(zheng)府(fu)(fu)审(shen)(shen)定(ding)(ding),原则上2017年底(di)前要(yao)清理(li)完毕。对(dui)(dui)市(shi)场主体反映比较强烈、问题暴露比较集中(zhong)、影(ying)(ying)响比较突出(chu)的(de)规(gui)定(ding)(ding)和(he)(he)做(zuo)法,要(yao)尽快清理(li)和(he)(he)废(fei)止(zhi)。对(dui)(dui)以合同协议等形式(shi)给予企(qi)业的(de)优(you)(you)惠(hui)政(zheng)(zheng)策(ce),以及(ji)部(bu)(bu)(bu)(bu)分立即终止(zhi)会带来重(zhong)大(da)影(ying)(ying)响的(de)政(zheng)(zheng)策(ce)措(cuo)施,可设置(zhi)过渡期(qi),逐步(bu)清理(li)和(he)(he)废(fei)止(zhi)。对(dui)(dui)已兑现的(de)优(you)(you)惠(hui)政(zheng)(zheng)策(ce),不溯及(ji)既往。对(dui)(dui)建立公(gong)平(ping)竞争(zheng)审(shen)(shen)查(cha)制(zhi)度后(hou)出(chu)台的(de)政(zheng)(zheng)策(ce)措(cuo)施,各(ge)级政(zheng)(zheng)府(fu)(fu)及(ji)所属部(bu)(bu)(bu)(bu)门要(yao)在定(ding)(ding)期(qi)清理(li)规(gui)章和(he)(he)规(gui)范(fan)性(xing)文(wen)件时(shi),一(yi)并对(dui)(dui)政(zheng)(zheng)策(ce)措(cuo)施影(ying)(ying)响统一(yi)市(shi)场和(he)(he)公(gong)平(ping)竞争(zheng)的(de)情(qing)况及(ji)时(shi)进行效(xiao)果评估。鼓励(li)委托第三方(fang)开展评估。对(dui)(dui)经评估认为(wei)妨碍统一(yi)市(shi)场和(he)(he)公(gong)平(ping)竞争(zheng)的(de)政(zheng)(zheng)策(ce)措(cuo)施要(yao)及(ji)时(shi)废(fei)止(zhi)或者按(an)照(zhao)公(gong)平(ping)竞争(zheng)原则修改完善。各(ge)地(di)(di)(di)、各(ge)部(bu)(bu)(bu)(bu)门要(yao)紧(jin)密结合实际,抓紧(jin)制(zhi)定(ding)(ding)清理(li)废(fei)除相关政(zheng)(zheng)策(ce)措(cuo)施的(de)工(gong)(gong)作方(fang)案,明确(que)工(gong)(gong)作方(fang)式(shi)、工(gong)(gong)作步(bu)骤和(he)(he)时(shi)间节点,加强工(gong)(gong)作指导和(he)(he)推(tui)动,确(que)保本地(di)(di)(di)、本部(bu)(bu)(bu)(bu)门清理(li)废(fei)除相关政(zheng)(zheng)策(ce)措(cuo)施工(gong)(gong)作稳(wen)妥推(tui)进。


  四(si)、突出(chu)重(zhong)点领(ling)(ling)域公平竞(jing)(jing)争审查。省(sheng)发改(gai)委(wei)(wei)、工信委(wei)(wei)、商务厅、财政(zheng)厅、住建厅、工商局、质(zhi)监局、省(sheng)政(zheng)府法(fa)(fa)制办、省(sheng)物价监管(guan)局等部(bu)(bu)门要结合工作职责,组织实施(shi)好各(ge)自领(ling)(ling)域的(de)公平竞(jing)(jing)争审查工作。要加强与对(dui)口国家部(bu)(bu)委(wei)(wei)的(de)沟通,密切(qie)关(guan)注(zhu)国家相关(guan)部(bu)(bu)委(wei)(wei)的(de)工作进展情况(kuang),及时(shi)制定(ding)贯彻落(luo)实措施(shi)和办法(fa)(fa)。


  五、加强公(gong)平(ping)(ping)竞(jing)(jing)争审(shen)(shen)(shen)查(cha)(cha)(cha)工(gong)(gong)(gong)作组(zu)织领导。建立黑龙江省(sheng)公(gong)平(ping)(ping)竞(jing)(jing)争审(shen)(shen)(shen)查(cha)(cha)(cha)工(gong)(gong)(gong)作联(lian)(lian)席会议(yi)制(zhi)度(du),负责(ze)部署(shu)和指(zhi)导全省(sheng)公(gong)平(ping)(ping)竞(jing)(jing)争审(shen)(shen)(shen)查(cha)(cha)(cha)制(zhi)度(du)实施工(gong)(gong)(gong)作,研究公(gong)平(ping)(ping)竞(jing)(jing)争审(shen)(shen)(shen)查(cha)(cha)(cha)制(zhi)度(du)实施中(zhong)的(de)重大(da)问题,对各地、各部门(men)(men)的(de)审(shen)(shen)(shen)查(cha)(cha)(cha)和清理情况(kuang)组(zu)织第三(san)方开(kai)展(zhan)(zhan)(zhan)评估,不定(ding)期组(zu)织开(kai)展(zhan)(zhan)(zhan)督(du)查(cha)(cha)(cha)。联(lian)(lian)席会议(yi)办(ban)公(gong)室设在省(sheng)物价监管(guan)局,负责(ze)推(tui)进(jin)全省(sheng)公(gong)平(ping)(ping)竞(jing)(jing)争审(shen)(shen)(shen)查(cha)(cha)(cha)制(zhi)度(du)实施的(de)日常工(gong)(gong)(gong)作,具体负责(ze)情况(kuang)沟通(tong)、工(gong)(gong)(gong)作协(xie)调和督(du)办(ban)落实。各市(地)、县(市、区)政(zheng)府(fu)(行署(shu))和省(sheng)直(zhi)各部门(men)(men)也要(yao)建立相应工(gong)(gong)(gong)作机制(zhi),推(tui)进(jin)本(ben)地、本(ben)部门(men)(men)公(gong)平(ping)(ping)竞(jing)(jing)争审(shen)(shen)(shen)查(cha)(cha)(cha)工(gong)(gong)(gong)作,及时向省(sheng)公(gong)平(ping)(ping)竞(jing)(jing)争审(shen)(shen)(shen)查(cha)(cha)(cha)工(gong)(gong)(gong)作联(lian)(lian)席会议(yi)报告(gao)工(gong)(gong)(gong)作开(kai)展(zhan)(zhan)(zhan)情况(kuang)。


  六、健全完善(shan)(shan)(shan)市(shi)(shi)(shi)场(chang)(chang)竞(jing)(jing)争(zheng)(zheng)规(gui)则(ze)(ze)和政(zheng)(zheng)(zheng)(zheng)府(fu)守信(xin)机(ji)(ji)(ji)制(zhi)。各(ge)地、各(ge)部门(men)要(yao)(yao)(yao)按照确立竞(jing)(jing)争(zheng)(zheng)政(zheng)(zheng)(zheng)(zheng)策(ce)(ce)(ce)(ce)基础性地位的(de)(de)(de)要(yao)(yao)(yao)求(qiu),以(yi)消(xiao)(xiao)除壁垒、打破垄断(duan)、引(yin)入竞(jing)(jing)争(zheng)(zheng)、优(you)化环境(jing)为重点,有针对性地制(zhi)定政(zheng)(zheng)(zheng)(zheng)策(ce)(ce)(ce)(ce)措施,及(ji)时研究(jiu)新(xin)经(jing)济领(ling)域市(shi)(shi)(shi)场(chang)(chang)监(jian)管(guan)问(wen)题(ti),不断(duan)完善(shan)(shan)(shan)公(gong)(gong)平、开放(fang)、透明(ming)的(de)(de)(de)市(shi)(shi)(shi)场(chang)(chang)竞(jing)(jing)争(zheng)(zheng)规(gui)则(ze)(ze),加(jia)快(kuai)建立竞(jing)(jing)争(zheng)(zheng)政(zheng)(zheng)(zheng)(zheng)策(ce)(ce)(ce)(ce)与(yu)产业、投资等政(zheng)(zheng)(zheng)(zheng)策(ce)(ce)(ce)(ce)的(de)(de)(de)协(xie)调机(ji)(ji)(ji)制(zhi),促(cu)进(jin)(jin)统一开放(fang)、竞(jing)(jing)争(zheng)(zheng)有序的(de)(de)(de)市(shi)(shi)(shi)场(chang)(chang)体系建设(she)(she)。要(yao)(yao)(yao)进(jin)(jin)一步(bu)加(jia)强(qiang)(qiang)政(zheng)(zheng)(zheng)(zheng)府(fu)信(xin)用体系建设(she)(she),严格履行(xing)政(zheng)(zheng)(zheng)(zheng)府(fu)向社会作出(chu)(chu)的(de)(de)(de)承诺,把政(zheng)(zheng)(zheng)(zheng)务(wu)(wu)履约(yue)和守诺服务(wu)(wu)纳(na)入政(zheng)(zheng)(zheng)(zheng)府(fu)绩(ji)效评(ping)价体系,建立健全政(zheng)(zheng)(zheng)(zheng)务(wu)(wu)和行(xing)政(zheng)(zheng)(zheng)(zheng)承诺考(kao)核制(zhi)度。要(yao)(yao)(yao)对依法作出(chu)(chu)的(de)(de)(de)政(zheng)(zheng)(zheng)(zheng)策(ce)(ce)(ce)(ce)承诺和签(qian)订的(de)(de)(de)各(ge)类合(he)同认真履约(yue)和兑现,不得(de)随意变规(gui)划、变政(zheng)(zheng)(zheng)(zheng)策(ce)(ce)(ce)(ce),不守信(xin)用。完善(shan)(shan)(shan)政(zheng)(zheng)(zheng)(zheng)务(wu)(wu)诚信(xin)约(yue)束和问(wen)责(ze)机(ji)(ji)(ji)制(zhi),对省(sheng)(sheng)委、省(sheng)(sheng)政(zheng)(zheng)(zheng)(zheng)府(fu)出(chu)(chu)台的(de)(de)(de)促(cu)进(jin)(jin)经(jing)济发展、改善(shan)(shan)(shan)发展环境(jing)、扩大招商引(yin)资等方面优(you)惠政(zheng)(zheng)(zheng)(zheng)策(ce)(ce)(ce)(ce)要(yao)(yao)(yao)加(jia)大落实(shi)力度,任何地方和单位均不得(de)以(yi)“实(shi)施细则(ze)(ze)”等形式设(she)(she)置新(xin)的(de)(de)(de)限制(zhi),已经(jing)设(she)(she)置的(de)(de)(de)立即取消(xiao)(xiao)。要(yao)(yao)(yao)进(jin)(jin)一步(bu)推(tui)广重大决策(ce)(ce)(ce)(ce)事项公(gong)(gong)示和听证制(zhi)度,拓宽(kuan)公(gong)(gong)众(zhong)参与(yu)政(zheng)(zheng)(zheng)(zheng)府(fu)决策(ce)(ce)(ce)(ce)的(de)(de)(de)渠道,加(jia)强(qiang)(qiang)对权力运行(xing)的(de)(de)(de)社会监(jian)督和约(yue)束。


  七、加(jia)强(qiang)宣(xuan)传(chuan)培(pei)训。各(ge)地(di)、各(ge)部(bu)(bu)(bu)门要(yao)(yao)(yao)(yao)加(jia)大宣(xuan)传(chuan)力度(du),加(jia)强(qiang)政(zheng)(zheng)(zheng)策(ce)(ce)解读和(he)(he)舆(yu)论引导,增(zeng)进(jin)(jin)全(quan)社会(hui)对公(gong)(gong)(gong)平(ping)(ping)竞(jing)(jing)争(zheng)(zheng)审(shen)查制(zhi)(zhi)(zhi)度(du)的认(ren)识(shi)和(he)(he)理(li)(li)解,培(pei)育公(gong)(gong)(gong)平(ping)(ping)竞(jing)(jing)争(zheng)(zheng)文化(hua),为公(gong)(gong)(gong)平(ping)(ping)竞(jing)(jing)争(zheng)(zheng)审(shen)查制(zhi)(zhi)(zhi)度(du)实(shi)施营造(zao)良(liang)好的舆(yu)论氛围和(he)(he)工(gong)作(zuo)环(huan)境。要(yao)(yao)(yao)(yao)加(jia)强(qiang)公(gong)(gong)(gong)平(ping)(ping)竞(jing)(jing)争(zheng)(zheng)审(shen)查业务培(pei)训,提升公(gong)(gong)(gong)平(ping)(ping)竞(jing)(jing)争(zheng)(zheng)审(shen)查人员专业化(hua)水(shui)平(ping)(ping),增(zeng)强(qiang)政(zheng)(zheng)(zheng)策(ce)(ce)制(zhi)(zhi)(zhi)定(ding)机关(guan)(guan)(guan)自我(wo)审(shen)查效能。八、强(qiang)化(hua)监督问责。对涉嫌违(wei)反公(gong)(gong)(gong)平(ping)(ping)竞(jing)(jing)争(zheng)(zheng)审(shen)查标准的政(zheng)(zheng)(zheng)策(ce)(ce)措(cuo)施,任何单位(wei)和(he)(he)个人有权举报,有关(guan)(guan)(guan)部(bu)(bu)(bu)门要(yao)(yao)(yao)(yao)及(ji)时(shi)进(jin)(jin)行处(chu)(chu)理(li)(li)。涉嫌违(wei)反《中华人民(min)共和(he)(he)国反垄断法》的,省物价监管局、工(gong)商局、商务厅等(deng)反垄断执法机构要(yao)(yao)(yao)(yao)依法调(diao)查核实(shi),并向(xiang)有关(guan)(guan)(guan)上级机关(guan)(guan)(guan)提出处(chu)(chu)理(li)(li)建(jian)议。案件(jian)情况(kuang)和(he)(he)处(chu)(chu)理(li)(li)建(jian)议要(yao)(yao)(yao)(yao)向(xiang)社会(hui)公(gong)(gong)(gong)开(kai)。政(zheng)(zheng)(zheng)策(ce)(ce)制(zhi)(zhi)(zhi)定(ding)机关(guan)(guan)(guan)要(yao)(yao)(yao)(yao)及(ji)时(shi)纠(jiu)正排除和(he)(he)限制(zhi)(zhi)(zhi)竞(jing)(jing)争(zheng)(zheng)的政(zheng)(zheng)(zheng)策(ce)(ce)措(cuo)施,维护公(gong)(gong)(gong)平(ping)(ping)竞(jing)(jing)争(zheng)(zheng)的市场秩序(xu)。对未(wei)进(jin)(jin)行公(gong)(gong)(gong)平(ping)(ping)竞(jing)(jing)争(zheng)(zheng)审(shen)查或(huo)者违(wei)反公(gong)(gong)(gong)平(ping)(ping)竞(jing)(jing)争(zheng)(zheng)审(shen)查标准出台政(zheng)(zheng)(zheng)策(ce)(ce)措(cuo)施,以(yi)及(ji)不及(ji)时(shi)纠(jiu)正相(xiang)关(guan)(guan)(guan)政(zheng)(zheng)(zheng)策(ce)(ce)措(cuo)施的政(zheng)(zheng)(zheng)策(ce)(ce)制(zhi)(zhi)(zhi)定(ding)机关(guan)(guan)(guan),有关(guan)(guan)(guan)部(bu)(bu)(bu)门依法查实(shi)后(hou)要(yao)(yao)(yao)(yao)作(zuo)出严(yan)肃(su)处(chu)(chu)理(li)(li)。对失职渎职等(deng)需要(yao)(yao)(yao)(yao)追(zhui)究相(xiang)关(guan)(guan)(guan)人员党纪政(zheng)(zheng)(zheng)纪责任的,要(yao)(yao)(yao)(yao)及(ji)时(shi)将有关(guan)(guan)(guan)情况(kuang)移送(song)纪检监察机关(guan)(guan)(guan)。
